You can register trademarks online yourself for a nominal fee, and it's not that expensive even if you hire an attorney to do it for you.
Consider the money that you'll be able to wring out of a company like USM if you sue them and win - not to mention the precedent that you'd be setting. Gibson, Fender et al. would think twice about suing the little guys if they start suing back.
There's no point in arguing that "ripoffs" are unfair if no one's going to take the steps to protect what's being ripped off in the first place.
