Total Cell Phone Ban While Driving?

I agree with banning texting, but talking on the phone seems like a bit of a stretch for a lot of people with hands free sets.

Im all for banning texting behind the wheel. I dont even think that using a cell phone (non-hands free) is that big of a deal to those who do so responsibly, but I have seen how it can be a problem for some other people. Banning hands free devices seems unecessary to me, and if the point of contention is that a phone call distracts drivers regardless, then I think car stereos should also be banned. As well as manual transmissions. And passenger seats. And freeway billboards. Im sure Im missing something...

So how long before legislation is passed stating that car stereos are a distraction? What about all those billboards along the freeway?

Personally, I think some people are capable of using a phone, handsfree or not, while driving and others are not. What about those people who cant keep two hands on the wheel because they drive a car with a manual transmission? Should all cars be automatic because we should all have two hands on the wheel at all times?

Poeple should know thier limitations. I know mine and that's why I'm smart enough to know that for me, driving and talking on a phone doesn't mix.

Right, and thats a perfect example of user responsibility. I only quoted your post as it gave me a good jumping off point, and wasnt really directing my comment at you.

Motorcyclists know of the increase risk that comes with driving a motorcycle instead of a car. If your safety is that important to you then I'd think you'd opt to drive a car instead. Otherwise you'd realize that a phone is like any other distraction. You can substitute one for any other with similar results and risks.

In saying that you are picking and choosing who's rights or who's convenience you find more important.
What if I do not agree? Do I get to choose who's rights, convenience or even opinions are more important on a subject you find pertinent? ...If so, what kind of bass do you play again? Does my opinion matter more than yours on that subject? Do I get a say in what you should or should not play?


Obviously I would not deny anyone that choice, but I think you get the point. In trying to dictate what motorcyclists should ride/drive You are removiung their freedom of choice based on your own self interest

I dont think he is trying to dictate anyone's choices when it comes to transportation. I feel like he is saying when one chooses to ride a motorcycle, that person is aware of the inherent risks in making that choice. If one cannot accept those risks then said person should choose their transportation more wisely. A driver is no more distracted by their phone than they are kids in the backseat yelling out "I want McDonalds!!" or slowing down to view an accident scene, or changing the CD in their stereo. All things a rider should consider before choosing a moto as their form of transportation.

This is why we need to develop teleportation. Or at least those giant Home Depot/Bank Deposit suction tubes used for transportation in Futurama.

Likewise, implementing such a ban would take away someone's choice to make a phone call if they need to while driving. And again, if studies show that these sorts of bans don't actual help then what's the point of the ban? We've actually had such a ban in my area for a while now and yet I constantly see people on their phone while driving. It just seems naive to think this ban would really solve anything or fix the problem.

Also, I wasn't saying people can't choose their mode of transportation... I'm not quite sure where you got that. I just meant that there is a more inherent risk in driving a motorcycle, and that people who choose the drive them need to accept those risks before getting on the road with one. If they can't, then they might want to choose to drive a car instead.
 
I would prefer if the wording was changed to "while a vehicle is in motion" and included the manipulation of touch-screen devices, dealing with small children (teach your kids to behave, or better yet don't have them), and then I would suggest something along the lines of Type-Certification for certain vehicles. You want to drive a big 4-door 4x4 pickup? Prove you can drive it. Same thing for a minivan, sports car, giant SUVs, or a big luxury car.

People tend to forget that they are playing with other people's lives when they are operating a vehicle while drunk/distracted/incompetently and I don't want to die because you're a numbskull.

There would be no way to enforce the safety of the general public otherwise.

I mean, things kill people all the time right? Who cares if they are useful, who cares if a huge percentage of people can use them without injuring somebody, who cares about peoples personal freedoms. If we just made everything illegal, nobody would ever get hurt, right!?

Why are cars legal? They kill people all the time, they are incredibly dangerous. It's like they are necessary or anything, it's just a convenience, you could function perfectly well without them. Lets ban them, lets do it. Everyone driving a car from today onwards gets a $10,000 on the spot fine. :rollno:



Several things come to mind here. First, correlation isn't causation, of course, and that's a very small sample size. Second, don't fiddle with the CD player while driving? I turn my changer on while I'm parked and rarely have to touch it while I'm driving--I might skip a CD, but it's very rare and I can do it at the light--whereas you have to answer a phone within a few rings. I'm also not continually distracted, as I would be if I was talking on the phone. The level of distraction is vastly different, IMO.

As for it not increasing our safety because some people will ignore it--you could say that about any law up to and including murder.

No, you can leave the phone to ring, and then call them back when you get a chance, I do it most of the time when I am driving, as the distraction of looking for my phone IS an impairment to my driving ability that could prove fatal in a lot of situations. When I get on an road that I know, where I know I am not going to have to do anything except maybe keep an eye out for a dog jumping out on the road or something, I am quite capable of quickly grabbing my phone and making a quick phonecall, even if it is just to say "Yeah, is it important? I am driving at the moment."

People say texting should be banned also, from my perspective, I know there is no way I could send a text while driving, however I know plenty of people who can send a text, one handed, without even looking at the screen of their phone. Thats less dangerous that using a phone, less dangerous than eating a sandwich, probably less dangerous than changing gear.

Er.. the point is you choose to ride a motorcycle full well, knowing it is dangerous.

Saying "You shouldn't be able to use a phone because I want to ride around on two wheel with little or no protection and I don't want to risk getting hit by you" just doesn't make any sense.

It is nothing to do with freedom of choice, you can ride a motorbike as much as you want. You do however, have to accept that doing so is an unnecessary risk to your health and as such you might just have to accept the consequences of that decision. You want to have the freedom to take an unnecessary risk (riding a motorbike), and plenty of car drivers also want to take an unnecessary risk (talking while driving), the two are not mutually exclusive.
