9 times out of 10 the very first chord is the key--- I would say C major as the verses imply with the C to A movement.
I hear it in Dmajor.
The Cmajor, (the first chord), might be temporarily obscuring the tonality , but the A7, always following the Cmajor, (and eventually arriving at Dmajor), is some very hard evidence for Dmajor. V7 - I is strong medicine.
Also - It ends on a Bminor, the Relative Minor of Dmajor.

The first note being played doesn't appear in the D major scale...correct me if I'm wrong but isn't he playing a C on the 3rd fret of the A string ?

C is a very common chord to use in D Major. Hundreds if not thousands of songs use that chord: Sweet Home Alabama, I Know You Rider, and Royals, are three songs that easily jump to mind. Can you think of others?
Not every chord of every song has to exactly "fit" with the key signature.

The melody note is D while the chord is C maj7.
To tell you the truth, it's a very simple chord progression:
Emin7 | A7 | Emin7 | A7 | D maj7, but...

If every song would only use the tones that belong to its key, music would be very boring.
As said by others, it is very common to use tones that don't belong to the key, in fact songs that do stick to that are the exception.
