Check out the FTC regs on shipping time claims. If they say "ships next day" or "orders ship in xx hours/days" and they can't deliver on time, they can't charge your card or charge you a cancellation fee.

What You Must Do If You Learn You Cannot Ship on Time

When you learn that you cannot ship on time, you must decide whether you will ever be able to ship the order. If you decide that you cannot, you must promptly cancel the order and make a full refund.

If you decide you can ship the order later, you must seek the customer’s consent to the delay. You may use whatever means you wish to do this -- such as the telephone, fax, mail, or email -- as long as you notify the customer of the delay reasonably quickly. The customer must have sufficient advance notification to make a meaningful decision to consent to the delay or cancel the order.

Some businesses adopt internal deadlines that are earlier than those set by the Rule to ensure that their delay notices give all customers a meaningful opportunity to consent to the delay. If businesses fail to ship or give delay notifications by their internal deadlines, they automatically cancel the orders and make refunds.

In any event, no notification to the customer can take longer than the time you originally promised or, if no time was promised, 30 days. If you cannot ship the order or provide the notice within this time, you must cancel the order and make a prompt refund.
What a First Delay Option Notice Must Say

In seeking your customer’s consent to delay, the first delay notice you provide to the customer (the "delay option" notice) must include:

a definite revised shipment date or, if unknown, a statement that you are unable to provide a revised shipment date;
a statement that, if the customer chooses not to wait, the customer can cancel the order and obtain a full and prompt refund; and
some means for the customer to choose to cancel at your expense (e.g., by providing a postage prepaid reply card or toll-free telephone number).
the following information when you cannot provide a revised shipping date:
the reason for the delay, and
a statement that, if the customer agrees to the indefinite delay, the customer may cancel the order any time until you ship the merchandise.

Report them to the FTC. They say they do not intervene on an individual case basis, but that they investigate violations and levy fines, However, I got overnight results when I reported a drop shipper who was trying to skirt the rules. They clean up their act real quick after just one phone call from FTC.

Man I really screwed this one up. I used to be vigilant against things like this but I dropped my guard I guess. I started to look up info about them and then I stopped.

Right now Im just trying to get a refund period. Well see if it has the 10 percent taken out of it when it shows up...

When I read this thread I was pretty upset so I sent them an email stating that I was told by a Warwick representative that they were not an authorized dealer and that I would be disputing it with this and that.

So I opened the paypal dispute simply stating to refund me for the bass hes not a dealer for.

I was fully refunded within minutes and I got an email saying hes not sure why they would tell me that, they are 100% authorized with the name Sound Connection (thats all the email said).

So thats over.

I'm sure they're saying that with the hopes that they gave you your money back and that you'll go away. I'm glad that you brought it up because I certainly won't order anything from them. If the Warwick rep says they aren't a dealer, they not a dealer. They may be getting them off the back of a truck for all we know, if they ever get them at all with the scam they seem to be running.

Glad you got your money back.

I will run this by our distributor as well. Thanks for the information, and glad to hear you were refunded. Best regards,

There ya' go. It would be highly unlikely for an unauthorized dealer to stock that bass. You order, you pay, they order from an authorized dealer, you wait for two sellers to supply your bass rather than one. Good post by Mr. Marino. :)

Sorry I wasn't more clear. Jay Marino is with US Music Corp, our distributor in the US. I am an official Warwick rep. Either way, we are here to assist in any way. Thanks!

Id like to thank the talk bass community posters with a special thanks to the company rep from Warwick for helping me out here.

I dont plan on just taking my money back and being satisfied.

Im going to submit several negative reviews with the BBB and other places.

I can't believe this...I am in the exact same predicament right now. I ordered a Warwick, they said it was unfit to be shipped, I chose another one and even paid 100 bucks more for the upgrade (on Wednesday) and it still hasn't shipped. People can be such scum with their scam nonsense. Well, I filed a dispute with paypal and I'm hoping that i'll get my money back. That's problem number 1. Problem number 2 is, where am I gonna find another Streamer LX Pro 5-string fretless??

If it were me I'd give this guy a shout. ;)

Looks like their registration address is probably a maildrop. There is a UPS store at the same address. I googled this Chris Rush guy, and found he is also president of American Sound Connection. If you go to [Invalid or Expired Link Removed] it gives a street address, which at google maps, appears to be a residence in Nixa. I bet you'd find that ASC has a similar record of complaints. I go to Springfield fairly regularly so I may look around Nixa a bit next time! :)

Bing Maps shows that address as a large, industrial warehouse structure, but Google Earth shows it as a residence a few hundred feet to the south.

<edit> Further research indicates it's the industrial building, about 36,000 square feet on 1.9 acres. Also, from another source:

"Company Description: American Sound Connection is based out of Nixa, MO which is 5 miles south of Springfield, MO. We are located right in the middle of the United States, and have excellent shipping times to all parts of the country. At ASC we want to be a business partner our customers can depend on. We stock everything we sell and at any given time we have between 8,000-10,000 enclosures in stock. Unlike many of our competitors that will only build your box once you place an order we are ready to ship it from the minute you call us. We can save you up to three weeks of shipping time by doing business this way. We do not brand any of our enclosures, by doing this our business partners can claim our enclosures as their own. Our success is based on our dealer's success and at ASC we truly understand that philosophy."
