Gibson refuses prize winnings

I’d like to hear Gibson’s side of the story. Something about the original post just does not sit right with me. What does a studio full of run down, worn out equipment, and unwise credit card purchases have to do with any of this?
I think he was putting the point over that the studio gear he had was dire and he could have done with the money that gibson were offering to upgrade his studio?

It may be a whining plea for sympathy, but either way, Gibson had a prize on offer to the winner, the winner did not get said prize.

I'd be whining aswell if someone was suckering me out of $10K !

Heard anything from Gibson about this?

If I took you to court to sue you, and the judge would allow only me to speak. Do you feel justice would be served?

If it was a legit competition, which it seems to have been, then its false advertising.

And this isnt a court, this is a public message board where people can express opinions on matters.

As long as the right not to deliver on the prize was incorporated as term of the contract prior to the formation of contract, Gibson are covered. And that covers all "small print" which is accessible to anyone entering the competition that might reasonably be expected to be read.

Similarly, this "prize winner" seems to have given no consideration in this, so his claim might not be bulletproof.

Sounded more like a whining plea for sympathy. I've contacted Gibson in order to try and get their side of the story.

Good luck getting a reply..you really think someone there is gonna give you the time of day to explain themselves on a matter that doesn't concern you?

And also, it's hardly a whine if the guy itemized every last detail he did over the course of MONTHS in good faith and got no satisfaction before taking it public....exactly how long would YOU make this guy wait? And why should it matter if the guy is a player or not? It sholdn't as he won and is entitled.

I feel compelled to ask if you feel this guy is in some way lying until you get a reply from Gibson? Do you side with Gibson? Just curious, not judging or attacking your character or anything, honest.

As soon as Gibson's lawyers have the press release ready, we will all hear. I feel sorry for this guy because Gibson will, in a legal sense, cut off this guys legs and throw him under a bus. Gibson will probably spend $100,000 (yes, even though the prize was $10,000) to make this guy's life miserable and scare anyone else from even thinking of asking for their prizes from any contest ever.

Obviously, this guy was actually under the impression that these contest are for real.

well, given their alleged "past form" in responding to emails, anyone incoming traffic might be waiting a while for a reply.

Similarly, I doubt Gibson will even offer a public answer on a matter that could very soon become a matter for the courts if litigation is pursued...

I've been following this story on Consumerist.com:

http://consumerist.com/349273/alleged-gibson-ceo-possibly-responds-to-10k-contest-story

A response(allegedly) from Gibson's CEO:
"I will investigate this issue and get back to you as soon as I get the facts. Since its Friday it will probably be early next week [hopefully Monday].
I will tell you that Don Pitts is no longer with Gibson and has not been with us for some time.

I have no personal knowledge about this issue and I personally approve all promotions for the company. We have a formal system where any agent of Gibson needs to present a promotion, its benefits and its cost. This then needs to be approved by a least two people before it comes to my desk. We do take these commitments seriously, and we have very strict internal processes to insure we deliver on our promises.

Regardless, I will get to the bottom of this and we will get you what was legitimately promised.

I do not know who you talked to other than attempting to contact Don, but we do have people on the phone 24 hours a day, seven days a week to solve any Gibson related issue [1-800-4-GIBSON]. While they do not have the authority to send you $10,000 worth of gear on the spot they are literally less than a minute from my office and should/could have resolved this in a very short period of time. If you had an unsatisfactory conversation with anyone else at Gibson, let me know so we can insure that this will not happen in the future.

Thanks for giving me the opportunity to address this problem."

Exactly. Hence my suggestion of an online petition, as singular emails are useless in a matter like this, it's too "he said she said"....a multi-hundred or thousand name petition might carry a bit more weight, alls I'm sayin.

edit: Chingas, color me surprised with that response. cool...glad to be "wrong" as it may be. May this guy get his goods.

This is a P.R. issue for Gibson. It should be their concern, not mine. I'm only interested in the resolution of the matter, not concerned.

If it were up to me he would have gotten his prize months ago. I don't care if he's a player or not. Why do you ask?

You give the impression there are two sides to this story. I agree. I'll withhold judgement until I've heard both.

I had a friend who won the John Lennon Song Writing contest, but the prize was from Yamaha, and it was the same deal, MSRP, and he had to pay sales tax. I guess that is how they do it. I just rather purchase my stuff, you could donate your prize to one of those high power organizations that supply kids with instruments and let them go the rounds with Gibson, I am sure Gibson would love that.

I really don't care unless I'm the one winning. I read this whole thing. At first I was man, what a jip. Then I was like wow, what would I get/do with 10k of Gibson's products, then I went through about 20 minutes of daydreaming about all the new gear. It was like gear porn in my head. Then I just started thinking about porn. Then asian chicks. Then I realized I really don't care unless I'm the one winning.

Sigh. I'm not a proud man. :scowl:
