Houston man found guilty using stand your ground defense

According to Germany's Der Spiegel, German police shot only 85 bullets in all of 2011, a stark reminder that not every country is as gun-crazy as the U.S. of A. As Boing Boing translates, most of those shots weren't even aimed people: "49 warning shots, 36 shots on suspects. 15 persons were injured, 6 were killed."


Interesting statistics here. Not saying we need to be like Germany and definitely not advocating limiting 2nd Amendment rights but I find the differences in cultures quite stark.

I'd be interested to hear what TB'ers from outside the US think about our rootin' tootin' shootemup country.

please explain the difference between your stance concerning this case as opposed to the case in Florida. the shooter in Florida was told to Stand-Down and someone was killed, yet you have backed the shooter. :confused:

Okay, I'm gonna try and explain my stance on why I feel one way about one and another about the other the best I can put it into words.

I feel in this case the guy was a bully, I think he went looking for trouble and found it. I believe he knew exactly what he'd do in the event that these guys at the party would have the audacity to challenge his authority.
I think he thought that he was completely justified if he could get them to come after him and was going to use the law as a free ticket to assert himself.

I don't see this being the case in Florida.
After listening to the 911 calls (The real ones, NOT the crap that the media tried to claim was the actual tapes) it was evident that there was no racial motivations behind it.
He was NEVER instructed to stop, He was told "we don't NEED you to do that" That is NOT a police issued order.
Not to mention, the operator is not in any position of authority to be dishing out orders to the general public.
This is also America, we are not under constant force by our government, if he wanted to follow him all day long that's his business. TM could get irritated, he could get mad, he could get angry, but he can not get physically violent.
Just as anyone else the only thing he could do under law is to call the police or leave the area.
It is also VERY evident that he was NOT following him but more so trying to simply keep knowledge of his whereabouts to relay to police either over the phone or when they finally arrived.
TM based on Z's own words had fled the scene and made his way in the direction of his fathers g/f's house. so much so that Z had completely lost sight of him.

Now if you look at the map of that neighborhood you can clearly see that is TM was able to break that corner he had ample time to make it to his home and be safe.

It is my belief that instead he decided to double back and return to the supposed area where he had just fled.
That tells me that he returned with intent on facing trouble head on. When he could have gone home instead.

I believe based on what I've seen that TM ran around the outside corner of houses and cut back through the common area and up through the backs of the two rows landing him face to face with Z at which point there was an altercation.

Witnesses placed TM on top of Z, Real unedited photos show obvious signs of trauma to Z that seem to be inline with his and witnesses statements.
It to me is evident that Z was the one on the tape screaming for help while he was getting beat up on the ground.

I just don't see where he did anything that warranted TM to attack him legally. And well once TM attacked him he in Florida has the right to use whatever force necessary to preserve his own life.
The question is did Z escalate the situation????
I don't see that he did. I see that he attempted to keep sight on a suspicious person that he had just seen looking into peoples property and acting very strange.
In the beginning of the tape you can hear Z saying that TM is reaching into his waistline for something and staring Z down and walking towards Z, that leaves me feeling like TM was attempting to antagonize Z at first and makes his doubling back seem VERY much in character for someone like that. This kid was looking for trouble and also found it.
It appears Z had in fact followed TM's path to the rear of the houses by the fence, then told 911 he didn't see him any longer at which point the asked are you following and he says "I was yes" "but he took off and is gone now" they say we don't need you to do that. At this point he clearly is not even able to follow him as he does not know where he ran to. and shortly after the call ends, leaving me to think he was then heading back to his vehicle (Altercation over right?)
No on his way back he walks past the opening where the backs of the two rows meet and sure as poop, there is the suspicious guy who has doubled back to confront Z and all hell breaks loose.
In my opinion the only way for TM to have gotten back to that location was if he decided to return to it. That makes him the aggressor at that point, the situation would have ended had he not done that.

Okay I'm sure TalkBass doesn't want this whole Florida issue getting fired back up so I'd be more than happy to continue this with you and am always for healthy debate as long as it is healthy and civil.

Whether or not Z was jumped by T he is a giant wuss in my book for having to use a firearm to subdue this kid. What kind of "neighborhood watch captain" doesn't carry some type of less lethal weapon like a billy club or mace. Sure the kid was probably a wannabe gangsta but to shoot an unarmed man because you are losing a fistfight is a cowardly act.


I feel in this case the guy was a bully, I think he went looking for trouble and found it.

Sums up both cases quite well.

Yes. He was losing a fistfight. Precisely. He outweighed the kid. Even if T got the jump on him. I stand by my assertion that Z is a wuss and if he can't defend himself against a smaller unarmed teenager then maybe he should refrain from vigilante law enforcement.

That's not a fist fight that's a beating. Z was obviously not much of a threat to TM anymore this is where TM could have and should have ended his attack even of Z did do whatever he had eliminated the threat and should have used this time to go home instead he just kept going over and over and over all through the screams from Z for help as he screamed over and over for someone to help him TM continued to pound on him.

How much more should Z have allowed, to be able to hold onto a nice tough guy status?
The fact that Z took the time to scream for help, and take the short beating that was enough to break his nose, and cut the back of his head pretty good, as well as swell parts of his face all before he made the ultimate decision to end the situation for the both of them.

TM should have used his off button and gotten off Z when he was screaming desperately for someone to help him.
Instead he kept going and going and going until Z pushed it for him.

Z in my book is the only victim in this situation. Poor guy will be the governments scape goat to appease the masses and masses of sheeple in our country of bleeding hearts for criminal types.
Z was a good guy by all accounts, definitely NOT a racist.
The guy had called 911 on 40 some other incidents and not one had him saying anything racial or unprofessional.
Not one ended in a murder or anything close.

TM was a wanna be thug who repeatedly was in trouble and choosing to emulate a thug type image, the fact that he was caught with a bag full of women's and men's jewelry and a screw driver adds huge weight to Z's reason to call 911 in the first place.

90% of what Z did that day was pretty much what any man would do had they have seen some thug looking around his neighbors property. Thank goodness not everyone in this world just turns a blind eye and closes their door on their neighbors when something isn't right.

We need more Z's in the world.

Already plenty of well armed folks who are afraid of their shadow and afraid to take a beating. When you masturbate to Dirty Harry movies long enough and think a gun makes you tough then these incidents are bound to occur.

You know cause that's reeeeeeeaaaaal tough I bet if he'd have laid there long enough to let TM pound him into a coma or worse he'd have made headlines as a real tough guy, maybe UFC would pick him up and pay him a 6 figure deal.

The only difference between Z & TM is TM was pretty dumb fighting a guy w/o knowing if he was armed and Z was smart to be armed just in case some thug ever decided to jump on him and start pounding his face in.

I can assure you there's very few "normal" people who will just lay there and think to themselves, "hey I'm so tough right now", while someone is beating on them, most will scream for help desperately and the few smart ones that arm themselves ,,,,, well,, they'll shoot you.

Well tough guy we don't live in the wild west, the stand your ground law is a relatively new law.

As reality would have it though he chose to be a violent thug in Florida. And in Florida, When you choose to physically assault another man and start beating his head into the ground and continue to do so after he clearly has started screaming for outside help or assistance HE CAN SHOOT YOU UNDER CURRENT LAW.
