Certainly not. By the time you’re in your early 20s most people can hear up to 16khz max, provided they haven’t done dumb things or been accidentally exposed to high SPLs which have damaged their hearing.Can humans even hear that high?
That 40khz boost-only shelf, as-described by the developer, can only do one thing: Boost frequencies above Nyquist (at 44.1 or 48khz sampling) which will result in foldback distortion, aka aliasing. Aliasing is audible but only below Nyquist so any added brightness being added by boosting this control will actually occur at and below 20khz (technically 22.05khz or 24khz respectively). What's worse is that aliasing is inharmonic to the original signal and can sound very unmusical and unpleasant, unless you're going for something that's meant to sound harsh by design. If you're working at 88.2, 96khz or higher sample rates the respective Nyquist frequency will be just above the knee of this shelf and while a portion of its processing won't alias, the bulk of what it does will.

Sure, which moves Nyquist up to 48khz but since the 40khz band on the aforementioned EQ plugin is a shelving type it will continue boosting above Nyquist and create aliasing. At 96khz sampling you can have a much steeper low pass filter below Nyquist without causing audible issues but then you’re defeating the purpose of such a high band anyway… inability to hear that high notwithstanding.96khz is easy these days, but there's a lot of things to consider.

This is debated inconclusively as it relates to analog signal paths. In a modern DAW there is built in low pass filtering as frequencies approach Nyquist which cut all of this content regardless. If working at 44.1 or 48khz sampling any content that could lead to some psycho-acoustic phenomenon gets filtered out and anything the user can perceive would be in the form of aliasing caused by fold back distortion. At 88.2khz sampling and higher… maybe… but I doubt it.Could there be psycho-acoustic effect of using eq at that high a frequency?
