Just found another Band using our band name...

I've run into this as well and it's amazing what a little courteous call can do.. The band was in the same market with a slight alteration of Los Sugar Kings.. The Sugar Kings.. I sent one nicely-worded email asking that they not use the name as we've been gigging on it and released some CDs , etc.. Guess what, they were just getting started and didn't mind changing their name at all.. No harm, no foul, no lawyers, no $$$ spent..

Wow, so you guys do all songs, all night about police brutality?
Jeez, that'd get boring quick.
I want to be entertained, not preached to.
Leave the activism to the activists and the music to the musicians.
Once you combine the 2, you instantly lose half your audience.

What you don't seem to realize is that good cops make it possible for you to sit around bashing them on the internet instead of spending all your time fighting for food and a safe place to sleep.

Are there bad cops? Sure but there are a lot more good ones and if it weren't for them we'd all be screwed.

Hate to break a few things to you but a quick google search reveals that all kinds of people are using that band name. Unless you're in the same locality as them, there's no need to even attempt a change. I don't think there's such thing as a unique band name these days.

Second, a band that only writes songs on one politically charged topic has a really low ceiling for advancement.

Given your federal trademark, I’d start with a cease and desist letter from the band. Something like:

Dear _____

We are the owners of a federally registered trademark (registration number 3591294) in the name FIVE-0. Our rights in this trademark include live performances by a musical band.

It has come to our attention that you are rendering musical performances under the name [insert other band name] which is [choose one: the same as/substantially similar to] our federal trademark. Your use of that name in this manner is likely to cause confusion, deception, and/or mistakes in that consumers are likely to mistakenly believe that your services are associated or affiliated with our services. Your use also violates our rights under both U.S. and state law.

We therefore demand that you immediately cease and desist all use of the name [insert other band name] and refrain from using it, or any similar mark, in the future. In the event you fail to comply with our demand, we have a number of remedies available to us including the filing of a trademark infringement claim.

We would prefer to settle this amicably and anticipate your immediate cooperation.
