just found my beloved stolen pedulla

Checking the for sale thread and found my stolen rapture pedulla in 1999 its a custom rapture pedulla . The guy is nice enough to sell it to me a little cheaper from what hes asking for .Im not sure if ill buy it although its my 1st 5er and my wife's gift to my b-day in 1997 (very sentimental ) but i didnt know its 17mm and im used to a 19 mm now.http://www.talkbass.com/forum/showthread.php?t=430332

It was stolen from my car broke my SUV window from a gated parking together with my xlt eden 210 and my dolly and left my gk800 rb probably not a gk fan:mad:.I was so tired and sleepy that night came from a gig and didn't have the energy to unload.
At first i wasn't sure if its my bass but when i got home and look for the pictures there it is!! its my exact custom rapture bass . I filed a police report that time but i was just wandering that they didnt get in touch with me coz the guy bought it at the Guitar Center Brea Ca.,usually 30 days trade in rules policy, probably lost my number and address coz i moved already.Anyways ill just buy it from the guy,:hyper: no sweat.

I know.

But it was your bass before it was stolen, it's rare you see your bass actually pop up after it's been stolen you know.

I wish TalkBass would allow like a donation type thing of sorts where a person could throw a buck or two in the pot for these situations to help the buyer get there gear back and the seller doesn't get screwed.

If it was stolen and you have a police report, you should still be able to get it back. The guy that has it now needs to pursue who he got it from. I'd contact the police and check into it before paying for it again.

Perhaps you should contact the police and find out what your rights are regarding stolen property. It's a bit odd that a seller wouldn't hold on to the instrument for a few days upon finding out that it was stolen.....

Since this involves me, I'll chime in. I bought this bass from Guitar Center a few weeks ago. As a corporate policy, they have to hold all trade-ins for 30 days to check for filed police reports (it's a pawn brokers law). Once it's clear to sell, they release it.

MAISKESO contacted me regarding the bass but never mentioned anything about pursuing any sort of legal action. He just wanted the bass back, so I offered it to him at less than what I paid at Guitar Center just so he could get it back. When I spoke to him he said he "might" be interested and would get back to me. In the meantime, I received an offer (higher than what I offered to MAISKESO) from another TB'er regarding the bass. I have not received payment as of yet (money is not in my account). MAISKESO calls me today and says he wants to come see the bass. I told him I already had an offer that I accepted because I hadn't heard from him.

So which deal am I supposed to honor? Usually on TB it's the first commitment that takes it. I know this is an unusual circumstance, but it honestly has nothing to do with me; it's up to Guitar Center/local enforcement to do their job and make sure the instrument is clear for sale. Not to mention that that bass was hanging up on their wall for months before I bought it.

I told MAISKESO that I would contact him if anything happened with the deal. He assured me that he was fine with that. I don't understand why he felt the need to post this. I just contacted the potential buyer and asked if I could renege on our deal due to the circumstances.

Legally that may be the case. But IMO, there is a deeper moral issue here regarding taking into account that the instrument in question is someone's former instrument which was stolen and also happened to be a gift with great sentimental value. If it were me, I would strongly consider that in my decision (assuming that everything stated here is correct) as it seems a special circumstance.

I agree with the sentiment that this is a special case. The bass should go back to its original owner, one way or another. The other buyer should allow the original owner of the stolen property to make arrangements to get his bass back. Even though the statute of limitations have run out, I wouldn't feel comfortable making a profit on it. jtlee, your offer to sell it back to the original owner for less than what you paid is admirable.

Guys thanks for all the comments but jtlee has nothing to do with what happened its just happened that he was there at GC and it was for sale so he bought it, I just got excited that for all these years that i've been looking for it and found it, its like a long lost relative. He pm'ed me today and he said that he explained to the other buyer the situation and it was cool .IM CLOSING THIS THREAD now thank you fellow TB'ers .

i am just sharing the pics , thanks to jtlee i got the bass last night and he sold it to me for less than from what he bought it for from GC and including set up, thanks jtlee.
