You don't know what "favours" she got "in return" for the bass gift, could have been many and varied or the relationship didn't work that way, you'll never get the truth anyway. I wouldn't be concerned about bile and vitriol, but unless he GIVES it back to her you want to follow Munji's advice.

Steering clear and making sure he does indeed ceed ownership back to her might not be too easy though.

We're going tomorrow to get her stuff back. The bass stays with him unless he wants to fight him over it. Either way I'm not touching it. To much bad juju. To much legal mumbo jumbo.

I will say she SERIOUSLY owes me for this. Damn family obligations.:rollno:
 
She bought it with her own money so there for it legally belongs to her. I think all the lawyers and judges would agree with my statement. She did buy it with her own money right? If her ex is your friend then it create a moral, trust, and friendship issue, but the fact that your friend went out with your sister would be a bigger problem because he would have broke Bro rule #1.

Bro rule #1 states that none your friends can go out with your any of your ex girl friends or family without your permission.

Obey the first Bro rule and nobody will get burned in any way, shape or form.

So you're now a legal expert (in addition to all your other fields of expertise you've mentioned)?

I will go out on a limb and unequivocally tell you, no, the lawyers and judges will NOT agree with that. It is entirely irrelevant that she bought it, with whatever funds she bought it with. The point you're missing is, she gave it to the guy as a present. Once she does that, it's his, he owns it, period. Anyone who takes it now and sells it or gives it away without his permission would be guilty of theft. And, in this case, the OP would be guilty of recieving stolen property should he accept it, and could be liable both criminally and civilly.
 
If I were in your place, I'd tell her to do what she feels is right and withdraw all further involvement in this story. Judge Judy is not the show you want to be seen on. Tell her that you'll help her get HER stuff but you won't have anything to do with the bass. D-bag or not, you gotta show a fellow bassist some respect. If he was a guitarist or just a bad person, then it would be different.

Respect that its not hers to take. She needs to find another way to get the bass.

Or think like this: if your girl got you a bass for your birthday or something, would you want her to take it after you dumped her?

Find where every one is or would be wrong. Then make a decision.

That's not even close to true if she gave it to him as a gift.

Absolutely nothing. It's not your business. It's theirs.

And best case scenario IMO is you get it back, he sues, you go to judge judy, and you give your band as many TV plugs as you can. Yes, you'd lose the bass (I've seen enough episodes also), but I think there's a fun twist cuz if she "gifts" the bass to you, then shouldn't it be that she can't take it back to give to him? :) Ahhh.... Judge Judy would just yell, "YOU CAN'T GIVE A GIFT THAT YOU STOLE FROM SOMEONE ELSE!!!!!"

Ya know, after just writing this, I changed my mind and actually think you SHOULD put your $.02, get the bass, and do everything in your power to get on judge judy. I'm sure you'd have lots of us watching. Go for it. It's the best case scenario I can see with this whole thing. The hell with the bass, you can get a used squier for $175. Milk this for it's true worth!
 
Maybe the bass has bad memories for him and he gives it back, or he agrees to give it back, in that case, he is (should be) transferring ownership back to her, who can give it to you.

If you take it without him willingly giving it to her or you, it's theft for sure.


Not a legal expert, but definitely don't take it unless he directly offers it to you or her.
