Legally, there is no question. HOA is right.

I understand that some TB members have had bad experiences with HOAs, and I've heard those horror stories, too. However, for 12 years I've lived in a neighborhood with a long-established HOA and I've been an officer in the Board on and off. We have a good group of people on the board (although too many lawyers for my taste - seems like every question we have to deal with turns into a discussion of setting precedents) and their decisions are usually thoughtful and compassionate.

For those who live in HOA neighborhoods with Board problems, my suggestion is to get on the Board where you can help bring about positive change. Most HOA Boards have to beg to get people to serve, so it's usually not hard to get elected. If you have a lot of problem people on the Board, get your neighbors together and get a bunch of level-headed people to run. Too many people would rather bitch about things rather get involved; I say put up or shut up.

By signing an agreement and then breaking that agreement, he is bringing shame on himself. He is a veteran and should realize by breaking rules he agreed to, he is also bringing shame on our country and flag. If you don't like rules there are ways to get them changed. If you think you are above rules because you served in the military you are selfish and ********. Grow up.

We just put a new house under contract. I'm thankful tht we found one in a beautiful neighborhood that has no HOA.

These days many HOAs are run by large, faceless corporations that maintain hundreds or thousands of HOAs across the nation. This makes them even less flexible and more expensive than the old locally run models.

F'in A Right. And exactly how was the 6' limit determined for a flag pole? Why not a 7' or a 12'er? 20' is a medium pole. But he signed the contract...he signed the contract! I understand that, but maybe he also has the moxie to say, "This rule sucks and is overbearing. I will challenge it and have a shot at changing it." Nothing wrong with that either as it is not actually disturbing anyone. "Oh, wait, oh wait...I can hear it flap sometimes! I think it is giving my dog nightmares! My life is fearful now. I am offended. If he had a 6' pole I'd not hear it. Get him!"

I agree with the quote above. 100%

Let me add that I think a slavish, knee-jerk reaction to "its a rule!" is what indeed puts people into slavery.

I think the HOA will lose in the case most recently cited. They are failing to conform to their own bylaws, so in the end they will lose. Of course, they're giving themselves a complete black eye while doing so.

MEKer and others, there is nothing wrong with living in an HOA area. Just do your homework and find out how it behaves before buying. And if you don't want to buy there, don't.

I choose not to live an any HOA-overseen development. Why? Because they are made up of people who get to make the rules. Any group of people with even token authority stands at risk of being eventually filled with friggen tools who have nothing better to do than get their jollies off on their little power trips. Doesn't make it right or wrong, just makes it reality... I'm absolutely sure that there are many HOA's who are level-headed, fair and easy to deal with. (for the moment at least) but I wont take the risk that they will ever stay that way.
If you can accept that reality, then by all means go HOA.
If however you want to fly a flag on a 20' flag pole, then you shoulda known better than move into a HOA situation and you have no one to blame except yourself.

One problem though is the HOA can completely change hands as far as who is in control. The developer of one neighborhood in my town handed control over to a national corporation. So you might move into a neighborhood after researching the HOA and then it could completely change on you.

Yup, that can happen. But as a homeowner, you still have the ability to take action along with your neighbors and have policies enacted as YOU choose. Those who get involved get to make rules. I've been on boards a number of times, and I can tell you that even a national corporation can ONLY enforce the bylaws and covenants which the residents of an HOA have voted for. If you and your neighbors don't like it, you can change it. if you're the only one who doesn't like it, you're outa luck...and that's how it works when you have neighbors. You may want to start an auto wrecking biz in the back yard, but the HOA is a-gonna shut y'all down.
