but if she works without any real paper work then its illegal no matter what and often employers take advantage of the fact that the person is working illegally and do not pay as promised, etc

Heres the thing though... the employer knows she isnt supposed to be working there legally. Now, who is going to walk into a Sushi place and question whether or not the cute Japanese server girl is working legally? In Ca, no one. She'll continue to work for that wage + tips until her visa expires, then she'll do what she plans on doing next, and none, but Maki, will be the wiser.

as a former waitress, I always got paid way under min wage but the tips made up for it.
A couple months ago, I was hired by the club i hang at, to be a jello shooter girl for one night for the 25th anny of the bar being in business. I had to work 5 hours and got paid a base pay of $20. I ended up with $115 for the whole night, in which was more an hour than I got working as a medical assistant in the same amount of time! that sucks! Shoot made more as a DJ in three hours that took me 2 days to make in 16 hours as a nurse!! Music is the route I am going for sure!!

Some things aren't so different over here.

Anyone who works as a fruit picker gets paid depending on what they pick. If they pick less than what would equate to minimum wage, they are topped up to minimum wage. (and if it keeps happening, they are generally fired for not doing the job right, it's pretty easy to pull in £15-£20 an hour).

On topic. I think she should look at employment through the university services, or even see what they say. I'll admit I don't know the employment laws in the US, but this stinks of being illegal.
