Technically? The name of the company was technically "Sunn Musical Instrument Co.", and the brand is "Sunn".
The "O)))" is just a modernized and stylized version of the picture of the smiley faced sun radiating rays that adorned the
original logo.
It believe was changed in '66 or '67 because the original logo looked "old fashioned".
Huh? FMIC bought the full rights to the brand, logo and trademark from the Hartzell Co. in late 1985 (?), and
still own them. Hartzell had owned the rights to Sunn since they bought the company from the founder, Conrad Sundholm, in 1971.
I think by took over you actually mean committed blatant copyright infringement.
I would imagine that they could be
forced to stop, I think the point is, why waste the money and effort pursuing them?

Personally, I think it applies here. Luckily (as far as the name is concerned, anyway) for them, their appeal and influence is
so fringe, and their revenue likely so
insignificant that Fender probably couldnt even recoup their legal fees to sue them, and IMO the band is so obscure that any negative overall effect that they have on the brand is negligible at best.
Coupled with the fact that Fender isnt even using the Sunn name presently, I would imagine that the attitude at FMIC would be Who cares?.
If there was any money to be had, or even if the artists influence reached a point where a measurable percentage of musicians (read; potential Fender customers) would identify the bands stolen trademark infringement directly to FMIC, Ill bet it would be a different story.
I actually asked a Fender AR guy about it at a NAMM show a few years ago and his answer was Who?.
I tried to explain it and he said Really? Theres a group out there calling themselves Sunn, spelled S-U-N-N? Hmmm
I wonder if legal knows about that.
As far as Sunn being pretty much the only amps they use, if I were a gambling man I would bet that the reason they used Sunn amps was because they were real cheap in the 90s, and theyre LOUD.
KramerBassFan is spot on, the 300T is
all Fender with Sunn badging. The last Sunn design was in the early/mid 80s.
And
Fender didnt dissolve anything; they just stopped production. If they wanted they could come out with a whole new Sunn line tomorrow.
P.S. This is my opinion/speculation based on the info I have. If anyone can provide proof that the band has FMIC's permission to use the Sunn trademark, I'll change my story and apologize for this post.
