Absolutely no smoking during the work day

Where I lay my head is home
My employer is enacting a new policy that employees are prohibited from smoking during the work day, even if they are off site on a meal break or commuting from one location to another in their own vehicle. Does anyone else have an employer who is this restrictive about tobacco smoking during the work day?
 
Ours used to allow smoking outside, but after the FD had to put out one too many dumpster/trash can fire they banned smoking anywhere on premise, parking lot, in your car on the lot, etc. Basically once you turn into the lot it's no smoking.
 
Well if you have some sort of job in a close quartered space (think office) or a sales job that has customer interaction, as a non smoker (irritates my nose) I can tell you if is off putting to smell stale ashtray and not be able to escape it. Factory jobs or a job where you don't deal with people directly, meh. Who cares.
 
Feels pretty heavy handed to me and I seriously doubt it would hold up to a challenge in the courts if somebody wanted to take it that far.

That being said... if they are going to go to that extreme then I would hope they would at least offer some sort of smoking cessation resources as a free benefit to their employees.
