Absolutely no smoking during the work day

Probably won't see surcharges for everything. Obamacare basically goes the other way. It limits higher rates based on age and the only surcharge it allows is for smokers.

Do you have paid lunch breaks? Because if not he can go screw himself.

This is along the lines of what I was going to post. They can't enforce (or even enact) policies for people off the clock and off premises. If they don't want you smoking off site during lunch then it needs to be made known that you're going to have to get a wage differential.
