Double Bass Bellafina Model 50.. screwy neck

Hey bass family,
I've got a Bellafina Model 50 3/4 size bass that is out of tune in the 3rd and 5th positions. This seems like a neck issue, is there a way to adjust it? Or should I send it back?

Correction* 2nd and 3rd. I reread this and felt kinda stupid lol

I'm interested in the answers you get. I thought the positions were determined by where the strings fall in tune...
