On 3/17, I was offered a trade deal from seabassman84. It was a great looking Carvin SB5001 for my American Deluxe Jazz V. The pics he sent me didn't match the actual bass which went unnoticed until 5 weeks later when the pickup cover was removed. I like the pickup cover on , which is why I never removed it. When it was removed by the new owner I sold it to, he sent me pics showing 2 additional drill holes into the body from someone adding the pickup cover as an after market mod on one side and three drill holes on the other. The new owner took it in to his Luthier and found a warp in the neck and a loose truss rod that while functional , seemed very odd. I happily returned his money and contacted seabassman84 to notify him of the issues( it was 5 weeks since our trade) because the pic he sent me showed no drill holes or pickup cover in the body of the bass. I asked him to trade me back and his response was that he spent $600 worth of upgrades on the bass I traded him yet, his new trade ad for the same bass makes no mention of any upgrades. The agreement was that he also include a $100 in the case because of the difference in value but he "forgot" to include it. I let it pass, though because the bass seemed fine but I didn't take it to a luthier when I received it. Am I off bad for being upset ?

Here's the pic and link he sent me representing the bass he traded me
TRADED - Carvin SB5001, Light and Lovely . I placed a negative rating on his trade rating ad a mod removed it ? Why ?

Really ? Wow.

Here's why.....in 5 weeks and two owners, I have no idea how the bass was handled. You clearly didn't notice the any issues with this bass, as you sold it to someone else. Assuming I wasn't aware of the issues when I sold the bass, I have no way of knowing who or what caused those issues.

Did you leave positive feedback then try to change it 5 weeks later??

So, the limit on misrepresentation is how long ?
That's a good question with a debatable answer but it's irrelevant because it wasn't your bass anymore. If I'm understanding correctly, the issues were noticed five weeks later by the buyer you sold it to. Not you. It's entirely your issue now, not the person who traded it to you.

Its completely understandable that these issues could go unnoticed for five weeks or even longer. Pickup cover was never removed to expose the hack job thru the pickguard into the body, action was acceptable / didnt need adjusting so truss rod issue was not exposed, if action is high enough a fretboard issue could go unnoticed. With these facts 5 months could have gone by and not caught on to the issues. Especially being a backup. Fact is the bass was misrepresented to session1969. I purchased it from him. Im the guy who noticed everything, well and my luthier. Fact is session1969 gave me my money back and took the issue on as his. Saying this is his issue is completely crazy, facts dont lie... the guy that sold the bass to him did lie.

The pickup cover hid the additional drill holes and the warp in the neck wasn't noticed until a luthier looked at it.

With all due respect, since I do not know 100% of the details, but I have some questions. In YOUR for sale ad for the Carvin, you described the neck as:

The neck is to die for, plays like butter

Later in the same post you said:

there is a small indentation/scratch on the back of the neck (pictured and looks worse than it is) that I knew about when purchasing and my luthier told me it's a $30 fix.

So was there a warp in the neck when the luthier looked at, or did it play like butter?

With regards to the drill holes: The rules state that any *known* modification needs to be revealed. If the individual that traded you the bass did not know about the drill holes, you cannot hold them accountable for them. Just as the person you sold it to cannot hold you accountable if you didn't know. From reports and posts that I've read, it doesn't appear as if he did. If this luthier did a thorough inspection, did they not take the pickguard off to check for any damage?

i side with the OP mainly because a new member comes to TB, a scandal occurred on his first transaction, and he's already trying to trade the OP's former bass WHICH WAS NEVER FULLY PAID FOR!
bad president, imo

even though i sympathize with @Session1969 the fellas above have the strongest argument against your case, Bro.
but it peeved me to see this crap happen. in the event the new guy is innocent,.. i apologize!

How in the world is anyone but the person you bought the bass from responsible for a lack of disclosure?

Owner #3 bought the bass from owner #2 who received it in a trade from owner #1.

Owner #3 claimed there were undisclosed issues and owner #2 gave him a refund and now wants to untrade with owner #1.

Owner #2 never noticed issues. It was his responsibility to notice and disclose them BEFORE he sold it. Not after.

What if owner #1 says he got it from owner #-1? Is it now owner #-1's responsibility?

Its simply

Look at the facts, its perfectly understandable, ive talked in depth with Session, his feedback is impeccable, I have a brain in my head. Again he was screwed first, then honorably took responsiblity and returned my money.

Look everybody, whats the headline of the OP? Okay....? After hearing that horror story would you deal with that guy? Now maybe someone else wont get burned.
A single dubious story isn't enough evidence for me to destroy someone's reputation. I'd also have very carefully inspected the item long before it was in my possession for five weeks.

So original pictures didn't show screw holes or a pickup cover, but it came with one on, how did you not notice that??

Something fishy with this thread. IMO it's unfair to @aproud1 for it to remain visible since it may wrongly cast doubt on his trustworthiness...
You're right. Aproud is the seller who sold it to the guy who traded it to the guy who sold it to the guy who claims their are issues, unless I'm misunderstanding something. Owner number three in this situation is the only responsible party, IMO.
