Cover band fees

I didn't read the whole thread, so my apologizes if this has been mentioned. This is straight from the ASCAP website:

"Some people mistakenly assume that musicians and entertainers must obtain licenses to perform copyrighted music or that businesses where music is performed can shift their responsibility to musicians or entertainers. The law says all who participate in, or are responsible for, performances of music are legally responsible. Since it is the business owner who obtains the ultimate benefit from the performance, it is the business owner who obtains the license. Music license fees are one of the many costs of doing business."

In summary, the venue is responsible for the license. The venue can't legally push the responsibility onto the musicians.

Personally I think the age old "cover vs. original" band argument is as exciting as listing the top sports movies of all times, it's tired and been done. I do have to give the OP credit though, been on here less than a month and has driven hits to his original bands website and youtube channel that otherwise woudn't have occurred, pretty clever.

Jimi Hendrix, Led Zeppelin, Van Halen, Elvis, Vanilla Fudge, and on .... All covered other peoples tunes. In fact, I would rather hear Jimi play Bob Dylan tunes than Bob Dylan. Nothing wrong with playing covers. I have always played in bands that was played some originals at cover gigs and covers at original gigs. I just like to play as much as possible and whatever I get paid is gravy. It keeps me sane.

Yeah - the whole "singer/songwriter" thing is a fairly new.
Evidently it's OK to _sing_ someone else's song, but not to _play_ someone else's song.

(Begs the question: Therefore - is a singer not a musician?" But that would be a separate thread.)

Or anywhere for that matter. I do believe there should be some BMI/ASCAP fee that these outfits should pay annually or nightly along with the bar venue whatever. I have seen tribute bands make some serious money playing other peoples songs. I wonder how Roger Waters likes that Aussie band touring the world selling out coliseums playing Floyd songs (they should be giving Floyd 90% of the money).

Yes, it's such a bizarre attitude from the OP. It seems the only band to ever permitted to perform a song should be the original artist.

So, if a band breaks up, or dies...no audience will ever hear those songs performed live again.

As for the clip....meh, I want my 5 minutes back.

Saw title and started reading thread. Seems to have gone off in a bunch of different tangents. LOL. Just to clarify and provide some 2cents:

1) The OP was not talking about originals better than covers. Although OP does not see point in playing covers, he admits that is his opinion.

2) To address OP's statement about cover band paying fees to play covers, there is a mechanism in place for song writers / composers to get paid. domdec314 even quoted the ASCAP rules (nice post domdec314).

So am not sure what all of the bickering is about? 10cc are you saying that ASCAP is wrong or the process for paying song writer / composers for their songs being performed is faulty?
