CRAAAAP, another taken band name

Alright so after playing by myself without a band for years and getting to my skill level I all of a sudden thought of a unique band name that I was surprised and thought no one had taken at first. The name was Noise. Weird enough, our vocalist thought of it before I met him so it even felt like fate to choose the name.

I looked it up countless times and found no one, not even in the 70s, 80s, nor 90s took the name. Although later I recently found a band from the UK named it from the 90s. Different country so I thought it'd be alright since they put Noise UK in their name.

However I just found another band named Noi!se and they are alive and active, on Facebook, put out records, have a label, and they are a street punk band. I want to use the name because it describes us exceptionally well as our sound ranges from bad ass riffs, hard rock, punk, metal, even got a hard rock into reggae instrumental going, and whatever else we can come up with and I got a lot of other guitar pieces in the vault.

They are from Tacoma WA and we're from Savannah GA pretty much just starting out. We should probably change the name but I really love the name. Just upset someone had actually thought of it after doing countless searches founding nothing and now to come to find with a ! in their name =/. Haven't even found their domain website but if they got a label, they got to be trademarked. www.noise.com isn't even registered

Naming a band and hoping it's unique is akin to choosing a login name only to find it's already taken.
Unless you are nationally famous or attempting to copyright the name, it doesn't matter if some band in Pudunk, Ohio
already has a band with the same name.

As a member of a band in Pudunk, Ohio, I take extreme umbrage at that comment. As a matter of fact, "Extreme Umbrage" is our name.

My apologies to all Pudunkians, some of my best friends are Pudunks.
Please note, "Extreme Umbrage" is already our band name. Cease and desist any further use of said name.
Note, for a small fee we can license you for unlimited use of "Extreme Umbrage".
 
Just spell it without the "i". That's probably not taken. :D

I've been in at least three bands that had names that were in use by multiple bands across the world. A lawyer once told me that trademarks are valid for the state that they are registered in, therefore someone in a different state can use the same business name. That was many years ago, so I'm not sure it's still true with the advent of the Internet.
