I am getting sued for being a hero

Even with the GS law, you can be sued. Happened not to long ago when a drunk girl rammed a tree, and a guy puller her out of the car. Then she sued him because he "damaged her and her property" when he saved her life.

To me, if you are in a flaming car KO'd and someone saves you, you owe them. Not the other way around.
 
Step 1: Hire the best lawyer who will accept payment on an after-verdict basis.

Step 2: Subpoena the Paramedics, the Police at the scene and any witnesses you may know.

Step 3: Make sure your Lawyers make her come across as the greedy witch she really is. Through testimony of Police/Medics show that the Police were not going to jump in and that had she not been pulled out she would have died. This will show the judge circumstantial evidence that you were the reason she is alive today.

Step 4: Make sure to sue her for legal fees, inc. court and lawyer fees, defamation and traumatic stress fees. Make sure you are called as a witness and demonstrate to the judge that this lawsuit has caused you lack of sleep or loss of work. The worst he can do is not award you damages.

Points if she cries in court after realizing what a whore she is.
 
Get the press involved. They love stories like this, especially on a slow week. They'll spin you into "Joe the rescuer," and the woman as an alcoholic/drug addict. The press will find the ugliest picture of her, or photoshop a drug addict to emphasize the true nature of her greed. It will swing public opinions, and any lawyer who tried to defend her will have their image tarnished. When the press interview you, remember to dress blue, and stand in front of the American flag. Also, it's always a good thing to mention god when you did something heroic. It'll definitely win you major brownie points. ;)

What needs to happen, metaphorically, is every single time some slimy sleazebag coprophagous pettifogger (thanks Munji :hyper: ) convinces some money grubbing sloped foreheaded nosepicker to SUE over being saved is to take their "stick" (i.e. the lawsuit) away from them, then beat them repeatedly in the face with their own "stick" until they bleed to death (i.e. sue them BOTH into bankruptcy).

A far wiser man once pointed that if there was only one lawyer in a town he made a living. If you let a second one in, before long they were both rich.

Based on her behavior you could probably kill her now and call it "justifiable homicide". Nobody sane would blame you in the slightest, which means that some D.A. would have you up on charges in an instant, unfortunately.
 
Yeah, helping people who are in danger of dying is a double edged sword. CPR requires one to actually crack a persons rib cage (or something like that) so you can compress air out of the lungs but damn if folks don't sue for injury! Thanks, I just saved your life and you sue me now?!

Not true, the Sternum is made of cartilage and it flexes. infact your ribcage spreads and flexes every time you breath. It takes immense force to break your ribs via pressure to your Sternum and would only happen under the most brutal cases of CPR.
 
I'll never understand why we don't have a loser-pays legal system.

A loser-pays legal system discourages REAL cases that SHOULD make it to court. Say a person was injured due to a manufacturer's product defect. The manufacturer likely has a team of lawyers that specializes in winning that type of case, a team that makes say $300,000 a case. The team of lawyers has a much higher probability of winning, even if the manufacturer is 100% guilty. So the poor schmo gets to suffer his injury AND pay $300,000+ if the outcome doesn't go his way.

Would you file a lawsuit if you knew you'd be on the hook for a $300,000 bill PLUS your own legal and court fees if you lost? If I had anything but a 100% certainty, I'd think twice about it for sure.
 
so, was this woman drowning? Was she able to speak? It sounds like there was a bit of standing around before she was pulled out. From what i'm hearing, i get the impression that she was stuck in a ditch and not particularly in immediate danger. Are you comfortable with CPR if she crashes as soon as you take her out of the car? I don't want to discount what you did, she definitely needed help, but i question whether breaking the window and pulling her out without the help of EMTs was the rational solution; i mean, we've all seen the incredibles...
