contrary to what you might think, that intro riff wasn't swiped from the Blues Magoos' "We Ain't Got Nothing Yet", but both of those songs got it from Ricky Nelson(and it appears that Joe Osborn is playing it)...

I think it has to go on for so many bars before it's plagerism; plus, that's just a riff, part of the arrangement, not part of the melody. It's certainly not something that Gershwin came up with.

The other part of the equation, if indeed Joe just plucked that out of the thin air to use as a bass line to play through their take on that song, it's once again part of the arrangement, which can't be copywrited. The Blues Magoos guys based their entire verse melody on that riff, but Joe would not have any legal standing. It's like how Carol Kaye actually came up with the riff on Sonny and Cher's "The Beat Goes On". It's just a simplistic, and not necessarily original, bass line; not part of the composition, but it became the recognizable hook of the song. As far as the Blues Magoos are concerned, it is listed as a group write, they could possibly have sued Blackmore and company, but then what was pilfered only lasts for two bars, after which they added that little syncopated tag at the end with the drum fills to round out their riff.​

I was surprised to be honest. It's not horrible at all, lol! Props to Wolfgang for pulling all that off so well! I can barely play bass, he's over here literally doing everything.
