My poor Passat.

You disagree? I'm not going to flaunt my pitiful 10,000 miles of driving experience, but I would agree with what i_got_a_mohawk said. If you're tailgating, it's absolutely your fault for rear ending someone.
Did I miss the post where Nino said he was tailgating her?

If you drive carefully, most accidents will be avoided.
Most, but not all. That's why it's called an accident.

10,000 miles of driving experience? Thats like a month for me. I don't know the laws in Sadowsky country, but over here if you rear end someone, it's your fault, doesn't matter, even if they were driving 70 and decided to panic stop for the H@ll of it. Anyway, I figure you've got about a new NYC with a custom figured top in a five string worth of damage, hope it works out, good luck!

Well, I have to agree with the kiddos here. You NEED to allow enough room between EVERY car in front of you to be able to come to a complete stop in an emergency situation. Now as others have pointed out, if someone cuts in front of you and slams the brakes, that is a little different. That is failure to yield by cutting into your space, and should be that persons responsibility on the end of that accident.

Come on people, have you seen how the majority of people drive?????? I want as much space to react from their stupidity as possible. But regardless, accidents are called just that for a reason, and it happens to everyone.

The key to not making the same mistakes or getting into the same types of accidents is to put your ego to the side and ask yourself; "What could I have done differently?" Nino was obviously following too closely unless of course his brakes failed or he hit the gas instead of the brake otherwise he would have been able to stop in time and not rear end the other car. This is why the accident will go down as his fault, because the assumption is that he wasn't in sufficient control of his vehicle. All it takes is a split second of inattention for an accident like this to happen which is why one has to take driving very seriously. I've been rear ended a number of times and the first thing I do when I come to a complete stop, especially a hard one is to see who's coming up behind me that's not in control and hopefully I've made it my business to leave myself an out. Accidents do happen, but driver error is usually the mitigating factor in most "accidents". It's okay to support Nino and sympathize with him, it's sucks when you're car gets damaged, but there is something he could have done to avoid the accident, and the recognition of that can go a long way for something like that not happening again.

Timeless words from judge Phil! I would suggest Nino, now that you've recognized the problem you get involved in a good twelve step program like Rear Ender's Anonymous and you will be on your way to a full recovery.

Rarely do I use someone’s age against them but... this time I will because you probably don’t have enough experience.

Trust me... what you said is not always true... Well its true 100% of times in books and I sadly it’s always true in eyes of the law (unless 3rd party says otherwise). Sure if person tailgates everyone he will get it and be wrong... but that assumption is wrong to use for all the cases. I don’t know what happen here but so many times it is fault of a person in front...

See examples I posted before.
Take my age into consideration, now, take this into consideration, my uncle was a police driver for about 30 years until he retired not too long back, there are things over here called advanced driving tests and that shows you how things are avoided and how to drive properly, trust me, ive had all this info drilled in.

Now, id agree with it being slightly less avoidable if someone cut right into him, even tho it is still avoidable if your using your mirrors, whats that? huh? you can see whats going on behind you HOLY **** MAN!
but thats not what he said, he said she stopped short, implying, he was riding her ass

I would repeat myself but o well...

None of those thing amply experience on subject to me.

It would be like someone telling you everything there is to know about bass but his source is uncle who played bass and a book... Driving is a skill...

What you just said makes no sense btw... how do mirror help with someone cutting-in in front of you and slamming on breaks? The car is NOT behind you its in front of you.

From what I’ve seen on the road and what I’ve witnessed... you are wrong to say that it always applies that person in the back is wrong. Sometimes its the case sometimes its not...

Not you nor me can tell if this was a case here or not because we were not there.

sorry to be a dick and all

but as much as it sucks, it is YOUR fault, you were obviously too close behind her or werent paying enough attention to pull an emergency stop in time, it is not her fault
OK, let me restate what I thought was obviously written.

Well, even though I think (IMO, IMHO) it's her fault, I did hit her (BLAMING MYSELF, STATING IT'S MY FAULT). So I feel like an ass (BECAUSE IT'S MY FAULT!!!!!!).

if your talking about cutting in like i think your meaning, then you should heave been aware of this car coming up the side of you then moving in too early

and right, seriously, the im older im better than you thing just isnt working, experience means nothing, just because some younger drivers are right ass holes (trust me, i know a couple, well, one, the other is dead now, yeah, related) doesnt mean they are all completelly deited and unaware of what happens, from my experience older drivers are often as bad because you get into ruts and bad habits, slight things you dont pay attention to, now, run along and pick up your pension :spit:

I did not say that I experience means better. I didn’t even question your ability of driving; I am sure you a good driver and I KNOW that there are plenty of good and bad drivers in any age. You are being way too protective about it.

I simply said that in 4 years that you have been driving you couldn't possibly witness all the situations to make a statement that you have made.

You example does not hold at all either. It sounds too... text book i guess... not real life.

Cheers

Ruling out mechanical failure i.e. your brakes fail, the only way you run into the back of another vehicle is because you're too close to them to stop in enough time. It's really that simple.

Once again... look at examples above... that is wrong... Some times it is fualt of guy behind sometimes it isnt.

Mechenical failure is most likelly your fualt because you didnt take care of a car enough.

When is it the fault of the car that you have run in to?

Mechanical failure could be anything, manufacturer defect, punctured tire from road debris, etc.
