My poor Passat.

Wow really sorry to hear about your accident. Hopefully no people or basses were injured!

It's cool to see another basser in a Passat. I just bought my Passat in March and I'm loving it! Mine is a B5 (1998-2001), compared to yours (B5.5 2001-2005) and I love it to death! The Passat really is one of the nicest affordable cars you can get! Hope you get yours sorted out soon! Here's my baby...

Sorry to hear about the accident Nino. Does NY have the law about anyone who hits another driver from behind, regardless of what the driver in front did, they're still at fault? In MA, she could've been talking on a cell phone, putting on her eye liner, polk her self in the eye with it, drop the cellphone, slam on her brakes, and if you hit her it would be your fault.

Hope it all works out bud.

Yeah, in MI, they dont care WHAT happened, if you rearend someone, it's your fault.

When I was 16, a lady stopped short in front of me. I tried to stop, but I slid on the ice. I hit her HARD. Totalled my car. My bumper was behind my front axle. Her bumper was bent a little. So I get out to check whether or not she's okay. It's a very old woman. She's laying face down on the steering wheel. "uh oh" I say. I knock on her window. No answer. "God, please tell me I haven't killed a woman" I knock even harder. Still no answer. I open her car door, to see if there is anything I can do. That's when I notice she is breathing. Breathing very strangely. Think darth vader. "Huh," i think, "is this some kind of F***ed up dream?" I put my hand on her shoulder, and she turns her head on the steering wheel to look at me. She is wearing a goddamn oxygen mask! Whoo! It scared the HELL out of me. I'll tell you what, I've never tailgated anyone in my life again after that. I guess what happened is when I hit her, she got scared and was having trouble breathing, so she turned up her oxygen. Well, she turned it up to high and passed out.

Anyway, Nino. Glad to hear you are alright. Don't want you injuring those precious hands before I get the money to order a Valenti.

It’s very simple...

Example... you keep your distance (really do) but person in front of you hits the breaks and stops on real end of entering a freeway and waits for clearance. This has happen here so many times its not even funny. You are speeding up... you are not cruising you are trying to get speed same as traffic to not interrupt it... this person in front of you stops...

1) You even though you have distance you have momentum of speeding up...
2) You are in disbelieve that this just happened

Another example is... you keep your distance and person hits the breaks on green just turning yellow and even they cant stop in time and roll out onto the intersection... again you are in disbelieve for half of sec and that’s enough.

I never rear ended anyone... I’ve had a person rear end me for same reason though... person in front of my stopped for no reason at all and guy was in disbelieve and speeding up into freeway... I managed to stop he couldn’t... he hit me lady just looked at us… laughed and drove away like she did nothing wrong.

Most of time when that happens I turn away... even go off the road if I have to... and worse is… those people think they do nothing wrong…

I don’t know what happened here but rear-ender is always at fault is one of the dumbest things ever… Like I never understand this… if I see someone behind me who wont stop I try my best to turn away from the accident… I give them room if I can… most people don’t even use rear-view mirror.

I've never rearended anyone...come close though. Both times were causes of severe sun glare. The first time I came upon a dark green dump truck who is was in a shady spot (so he blended in real well) stopped in my path, and I had solar glare. I BARELY stopped and swerved before hitting it. The second time was a lady who stopped for someone in a cross walk, and I couldn't see her that well because of solar glare. Had to slam on my brakes and swerve.

I drive for a living and have had many occasions where people have cut me off and slammed on their brakes in front of me to make a turn. this pisses me off to no end... 1. because i had ample following distance from the car that was previously in front of me 2. because i have to slam on my brakes hard to avoid totaling their car (even though they deserve it) 3. inertia sends all the packages in the back of my van slamming into the cage in the front of the van which is a pain to sort out later (luckily i only transport paper products).

I also love driving in chicago on the interstates... durring rush hour (basically 20 out of the 24 hours in the day) if you leave anything more than a car length between you and the car in front of you, someone will use it to cut across a minimum of one lane in front of you. those "absolute" laws really annoy me because every case should be evaluated on it's own.

You disagree? I'm not going to flaunt my pitiful 10,000 miles of driving experience, but I would agree with what i_got_a_mohawk said. If you're tailgating, it's absolutely your fault for rear ending someone. If you drive carefully, most accidents will be avoided. The way I avoid rear ending people is by leaving an ABSURD distance between myself and the car in front of me, making sure the people behind me leave enough room (;)) and if I see the brake lights come on in the car in front of me, I immediately apply the brakes. This makes me look like a fool more often than not, but it can also save you a lot of grief. (I don't mean stopping short though, just applying some brakes and being ready to stop short if I have to. Sometimes I'm tricked though...)

Rarely do I use someone’s age against them but... this time I will because you probably don’t have enough experience.


Trust me... what you said is not always true... Well its true 100% of times in books and I sadly it’s always true in eyes of the law (unless 3rd party says otherwise). Sure if person tailgates everyone he will get it and be wrong... but that assumption is wrong to use for all the cases. I don’t know what happen here but so many times it is fault of a person in front...

See examples I posted before.
