Ordered a custom bass, 15 mo's later...still don't have it.

Even tho I knew you were in the sh!tter when I read your OP, I still feel for you. Even tho I witness this sort of financial depravity all too often, it always burns me to hear about it.

You've gotten alot of "I'd be demanding a refund" and "Lawyer up" advice in this thread. I hope you can see the futility of such folly. You have no leverage, and Mr. Halo has made his intentions abundantly clear. As putrid as it may sound, at this point, were I you, I'd be making nice nice with Mr. Halo. I'd stop talking refund and deep discounts, because obviously that ain't happening, and you have no means to make it happen. Everything about your experience suggests Mr. Halo is operating on the fringe, at best, and headed in the wrong direction. I'd lock this thread, or delete it if I could. And I'd be doing my best to entice him to deliver me something, anything, before the ship totally sinks. Even if it's a POS, you'll at least be able to get some of your money back.

Couldn't disagree more. There were people on the Darren Huff thread advising against suing the guy because then he might never deliver...ten years on! The OP has got a legitimate complaint. Halo took his money and still has not delivered the bass he promised--15 months later. It is Halo who needs to make it right with the OP, not the other way around.
 
Back in the late 80's a couple of friends order a custom Jackson guitar (pre-Fender, during the height of the glam era).

From the time they placed the order to the time it was in their hands: 4 months and that was with delays.

We were transparent about this from the very beginning and you agreed to it at that time.

I want to make the situation better for you and resolve things amicably.
I am a bit uncomfortable with refunding and sending the bass.

You paid $xxxxx for this bass. What is a heavily discounted price for you?

They are building you your custom bass and offering you a partial refund even though it is against their policy.

I completely understand why they will not send you a refund and the bass. That is the equivalent of getting the wrong order from McDonalds drive through, going in to ask for your money back and then telling them you will not pay until after you have eaten you correct order.

Perhaps I wasn't clear. Of course Mr. Halo needs to make it right. Of course OP's got a legitimate complaint.

But what, if anything, have you seen in this thread leads you to believe demanding that Mr. Halo "make it right" will actually compel him to do so? I've seen nothing. That's what I was speaking to.

I would think so, their name has been mentioned, and when you mention someone else's name it sends them an alert I think. I don't know if they get an email or not though.
I don't think that's the case, unless you put an "@" symbol in front of their username, like so @shal1234.

Of course if they've come on TB in the last few days or googled their name, then they've likely seen it... But so will others, and that's the point.

Its not just the wrong order, its NO order was delivered. Have you ever worked in customer service? When this happens you give the customer a credit equal to or higher than the value, and let them keep the product. At least I offered to still pay for it. The bottom line is that the cards need to be put back into the customer's hands. I've been pushed around and lied to month after month. A free preamp isn't gonna cut it.

Both threads were educational and both deleted for reasons I can only assume were b/c he didn't want to piss off the builder who still had has $, or b/c other TBrs were outraged he would besmirch the honor of their favorite bass maker, who took 100% upfront and didn't deliver. What a great guy right?

Such crap behavior and nobody knows about it. So it'll happen again.

I get that a sticky won't be read by everyone, and a contract means skata to a builder whose going to take advantage of you anyway, but it might help some people.

Don't worry I won't delete it. I'm a pretty nice guy but when provoked I can get ugly. People underestimate this, and try to take advantage of me because I'm so passive. Then I let them know they messed with the wrong dude.
 
I haven't been following this thread with a magnifying glass, but I'm pretty sure I know most of the details. The situation sucks, but I haven't read anything that made me believe that Halo wasn't going to complete this order. I DID think that the demands made in the email to them were a bit over the top, and was going to chime in and say so, but realized the deed was already done so there wasn't much point. Even though they failed to live up to their initial delivery date, a complete refund followed by a delivery with an expectation of a big discount seemed unrealistic to me. Had they agreed to that I'd have been shocked. They already apologized and said they would compensate you for your time. I'd have given them the benefit of the doubt one more time.

I had 2 custom basses built for me. Neither were delivered when promised, and both had issues when I got them. I wasn't happy about it, but I didn't get overly heated about anything and all was resolved in the end. As I said in my first post here, I think anger and threats will only exacerbate this particular situation. OP stands to fair better by playing nice.

While I'd like to commiserate with you on the post below, I disagree that you're in the pooper. Sounds like you're going to get the bass you wanted, with a discount, a bit later than you hoped for. If it were me on the other side, I'd have responded the same way to your request.

Right now there is no serious damage to anyone involved here. You (OP) waited a year longer for your bass, but it seems you're going to get it very soon now with some additions to compensate for the errors on their part. Halo will save it's reputation if they deliver promptly and communicate well from this point on.

If Halo DOESN'T however deliver.... well, I think then they could pack up their business at this point regarding anyone at Talkbass. There are enough of us here that will make certain that nobody here deals with them again. That's one thing I think we talkbassers are really good at :). I don't know if anyone remembers my fiasco with Bass Northwest... can't say I'm happy about that whole thing, but I am happy that at one point I though it was enough, and had the thread removed.

We stick by each other over here.

[edit] Sh!tter if spelled correctly gets autochanged to pooper. I like that :). As dr00l spelled with "o"s and not zeros gets changed to drool. @paul is up late nights I'm sure thinkin this awesome stuff up :).

I somehow missed that on first reading.

How much off was their number from what you paid them? That might just be a simple error on their part. Again, I remember something similar happening with one of the basses I had made for me. That should be easy to fix assuming you paid with a check, paypal, or credit card. If you paid in cash then this is a done deal, and well... I'll leave it at that.
 
The email from Halo doesn't make sense - they don't want to send you a refund AND the bass - well yeah, that isn't what you asked for. Right then I'd have said "oh, no, you can take the bass and shove it up your ass. I'd like my money back now please."

As a matter of fact, at this juncture, your vocabulary in all correspondence with them should be exclusively the words "Where's", and "my", and "refund", and exclusively in that order.

If you get the bass and it's anything less than 100% the best thing you ever played, you're going to resent it. But by then, your options will have very likely dwindled to none.

That's what it sounded like he asked for to me.

I also think if he follows your lead he's going to wind up losing. They're in the position to call the shots, not him. Just my opinion.

I must not have read all the posts correctly, then; I don't know any situation where you'd ask for the completed instrument and your money back.

My position on the subject is simply from dealing with too many companies that get squirrely when you ask for your money back for reasons that are their fault. If it's my fault, like I ordered the wrong thing, then sure I might get resistance or even no refund at all, but I'm also not hard-nosed about it. But if it's their fault, and it's dragged on, I can't see anything besides holding their feet to the fire being productive.

I will propose this: Issue the full refund. If you are confident the bass is near completion and up to standards, you can send it to me and if I like it I will buy it at a heavily discounted price. If you aren't comfortable with that, then just issue the refund and we'll call it quits.

That didn't make sense to me when I read it yesterday, but I didn't comment. I'd have responded to that same as Halo did.

OHHHHHHH okay; I had read that message but somehow didn't register that it was what the OP had said to Halo.

I agree that is a strange proposal, that sets Halo up for grief at best. Sounds like a good counter would be "We send the bass and a partial refund for the troubles, and then if the bass sucks, you can return it for the rest of the refund." - it's outside both parties' initial assumptions and considerations, but it's the most amenable thing I can think of besides just a halt-and-refund.
