Problems with the law.

It was BS, and most of your problems resulted from being disrespectful to cop by feeding him a line of BS to justify being non-compliant. While I do feel that your ticket was excessive, and that I do feel you should try to fight it, even if it's just to reduce the fine, I do hope that the lesson learned here is to be compliant when a cop asks you to, and to not feed him a line of BS to continue being non-compliant. As you can see, this only leads to bigger problems.

The cop was completely within his rights to write the ticket - the ordinance pretty much leaves it to his discretion what constitutes a violation (whether or not that's a good thing is a completely different question).

He chose to go ahead and write the ticket because he felt the OP was displaying a bad attitude.

The "invited in" bit is probably a red herring. Once he decided that the ordinance was violated he could have stood at the open door and written the ticket.

My guess is that if OP didn't annoy him with the bogus finger cooling down bit no one would have gotten a ticket. Probably lucky he didn't ticket each member of the band.
 
When a cop says stop, you stop. You don't tell him what you're doing while implying that his request is unwarranted.

They have to deal with a lot of ********, so often they'll be harsh any time they see it coming.

The cop wanted your attention. You and your mates crossed the line, and he wanted to set you straight. Wanking around with your cool down showed him you weren't particularly interested in his point of view or his authority, and then trying to defend your behavior proved it even further.

I don't know what law school some of these posters went to, but my wife the partner in a law firm for the past 20 years tells me that the "F" for female on the ticket, sitting in the cruiser, and the cop entering the garage isn't going to get you anywhere with the judge. This law officer is an extension of the very judge (or district attorney) you will visit, and you better have something a little more substantial than that if you want to level criticism on the court system in your jurisdiction.

I will repeat my earlier sentiment: Apologize in court, leave the critical nitpicking out of your approach, and dummy up next time while you have the chance.
 
Actually, according to the OP, the police officer made a comment to the OP and the OP responded to the comment.

To the OP, arrive at court dressed appropriately, respond to the judge's questions (and only his questions). Saying less generally is best. If you believe the citation is incorrect (you were not in violation of the noise ordinance), just say so when asked (again short and sweet, no long stories) Point out any discrepencies on the citation (you are not a female, etc.)
The judges I've known in the past did not pick sides up front. Their job is to be neutral and, they generally are. They do expect and insist on all people in their courtroom to respect the court, being disrespectful to the court (loud, abusive or argumentative results in a nearly automatic loss and maximum fines.)

Probably a good analysis - the ordinance is so general that it's up to the cop to interpret it.

But - you have nothing to lose by appearing in court. With a nice appearance and a good attitude, you might at least get a reduced fine.
 
Some thoughts...

Sounds like the OP got the horn, which is the traditional gift when you mess with the bull.

The warming up/cooling down thing was pretty transparent. Maki nailed that. And when an LEO comes onto the premises because of the alledged actions of those on the premises, it's a good idea not to engage in anything remotely resembling that action. That really isn't rocket science for most people. If OTOH your hands are so cold/warm that you needed to warm them up/cool them down, maybe it's worth aggravating the officer. Maybe they needed to cool down from playing all that loud music:D.

My hands have never been in that particular state. Maybe RHS (Restless Hand Syndrome) is real?

As far as chipping in and paying the fine... I don't think I could stomach that. This brings to mind the passenger in the car during a traffic stop who just can't keep their mouth shut. I wouldn't do it so why would I pay for it? No offense.

I am wondering if anything was learned. It doesn't appear so.
 
Now that I think about this more, and considering the OP is probably Bad Brains/Blort/Borp, and whatever names he has been banned under, his history of posts bashing cops, his history of antagonizing those who don't agree with him, I'd say the story went something like this:

Band playing extremely loudly.

Neighbor calls in complaint.

Officer responds and bangs on door. Tenant of residence where practice was happening is not as big of a DA as Blort. Answers the door and opens.

"What's the problem Officer?" "We got a complaint you guys were playing too loud, can you please shut her down for the evening?" Blort runs up behind the officer and starts slapping as "loudly" as he can on his bass, pretty much for annoyance factor.
"You wanna stop that kid?". "It's not plugged in, you can't make me, I'm just cooling off my fingers dude....." ....then starts slap wanking again while making bass face and staring at the cop. "Oh ya? How about you come with me wiseass?". Leads Blort to car and writes him an attitude adjustment ticket.

Anyone want to wager this is MUCH closer to the real story than the original post?

AND even if it isn't BLORT, since the post doesn't appear to be from Detroit, I still put my money on this scenario

I cant believe some of you really believe I would embellish my story for the sake of winning over the support of a forum :confused: all the support in the world isn't going to do smack for me in front of the judge, ive really presented this as it happened and it disappoints me to see that some of you would think otherwise. The only comment I made to the cop was the one about my fingers, beyond that I did not say single word to this man except the responses I had to give for the info on the ticket. I thought you had to act in a threatening manner or cuss out the cop in order for you to be detained, but as it turns out simply contradicting a cop is enough to win you a backseat. As for my band mates offering to help me out, they understand that the reason the cop came in the first place is because we were all rehearsing :bassist: granted my comment won me the ticket but its the drummers house and he understands that if a ticket for loud music was going to be issued, it should have rightfully gone to him as he is the property owner and its his band. And about me being Bad Brains or Blort, im not -.- My respect for LE is still at an all time low and I despise them more than ever, but from now on ill swallow my pride and work against the porkers in a way that's not going to result in another 250$ infraction.

Everyone embellishes stories. The biggest tip-off here is the finger cooling-down. That doesn't even make sense.

You didn't get the ticket for "contradicting the cop," you got the ticket for "breaking the law." You may have gotten out of the ticket, still having broken the law, if you didn't feel the need to cool down your fingers while the cop wanted your attention.

On the topic of embellishment, it's good to see that the fine has gone down 50 dollars, however.

I thought the same exact thing but read the thread to see if anyone else noticed it. Cooling down my fingers..............can I guess your genre? Metal???? LMAO.

Just pay the fine and learn a lesson. Cops aren't your friends, and they don't have to be. They get paid to field complaints and enforce the law.

You were a complaint that day and they weren't happy to have to come to that practice spot to have a person talk back to them (as they saw it).

"Most" (not all) of the troopers I know around here have severe authority issues from a dad that beat them or a failed military career. Just say "Yes Sir" and nod.

we all know what happens when authority figures are challenged. we also all should understand that people will pile-on when you're down on the ground. the same comments ad nauseum until the thread dies. *

if i were you i would request that this thread be deleted. no one was there, but the moral majority is sympathetic to an alleged rude cop. i've had several noise related cop encounters and not one incident. and we are (major)"420" every time we rehearse, yet the cops in our area have MUCH bigger "fish to fry"!!! some of my best friends are LE and they would heckle that guy for turning in a lame ticket like that. *gl

I'm sure you believe to the core of your being that you weren't being a disrespectful smart-ass to the officer, but with your admitted hateful attitude toward them, it's completely impossible for you to hide your contempt for them when they are standing in front of you and you really can't help showing open disregard for their authority and thereby directly insulting them. That's why you got the ticket here and that's why you'll likely get more tickets from the cops in the future that you otherwise wouldn't have gotten.

Maybe you could reserve your contempt for the small minority of cops who truly deserve it and give a break to the decent, hard working cops who make up the vast majority and who really don't want to hassle you. You'll save yourself a lot of money in the long run.
 
I think the OP has his "despise" for LE/LEOs pointed in the wrong direction. Dude was just called in for a complaint made against your band breaking the law. If anything, you should either 1) learn the law and obey it or 2) talk to the person/people making the complaint and see if you can't come to some adult resolution on when and how loud you can practice.
I agree with hbarcat though. You just "hate" law officers, you were being a little brat to the one that responded to the noise complaint against you, and you rightfully got the ticket. I hope that the judge sees through your BS as clearly as most people here have, and laughs at you as you walk out of the courtroom with your ticket still in hand.
Someday maybe you'll grow up, learn to respect people, and avoid putting yourself into situations like this. I'm not holding my breath on that, though.
