6. Disputes, Arbitration, Class Waiver, Waiver of Claims and Venue


(A) JAMS: In the event a dispute arises between you and Reverb, please contact Reverb. Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in Cook County, Illinois, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with the Arbitration Rules and Procedures of JAMS. The prevailing party in any arbitration or other proceeding arising under this Agreement shall be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys' fees, expert witness fees and all other expenses) incurred in connection therewith.

" Illuminating" sounds more like insulating aka they have no insurance with the carrier

They are short selling coverage and then trying to weasel out of it when their luck craps out

I think they meant "eliminating" as in they are taking the carrier out of the equation.

At some point, you're going to have to get out of the pram, pick your toys up off the floor and compromise.
First off no idea what a pram is
Are you defending Ric's customer service? Maybe you need to give it a search but it's legendarily bad
My compromise is they can refund the buyer, take possession of the bass and do whatever they see fit with it.

Sorry..."throwing one's toys out of the pram" is a British expression. A pram is a baby buggy.

I am not trying to be mean - though I suppose my language isn't exactly nice - but my point is that you're obviously upset and feel hard done by. Unfortunately, you want what you want and are not willing to compromise. You can dig your heels in and refuse, but you are likely to end up out of whatever money you got for this bass and without a bass.

Maybe it will work out for you. But I think, at some point, you are going to have to work with the seller and Reverb to have the bass returned to you and assessed by a luthier.

Edit: I am under no illusions re Rickenbacker. I play a Ric, for the record.

I'm fairly certain after paying almost $400 for fees and shipping it's not unreasonable to expect an item to arrive safely and if not that the burden of the responsibility falls on neither the buyer nor the seller
