The contract we had was verbal and yes that is legally binding. The kb I bought when I was 20 , I am 36 now. That instument cost me 3200$ and I worked all summer to pay for it. I don't have any debt, I don't have any bills, I am completly free of the daily trap. No mortgage, no phone bill, bought my car with cash. I think Ken likes me and gave me a good price on my instruments. I love them to death!I private messaged you. I'm sorry you've had the trouble you've had with Rybski. I dig the Bebensee you have by the way. I knew a guy here who had one a long time ago. Nice guitars! If you're a man of little means, how did you afford that Bebensee? Those ain't cheap! Anyway, check out my message to you. Also, there is no legally binding contract unless he, you, or the both of you signed one. Rather than defame Rybski, I would seek out an attorney to get your money back. Being mean to him won't help your cause.
Thank you!The fact that Rybski isn't here leads me to believe everything Chauncey1 is saying is dead on. I don't care if someone does this to just one person, in my book it makes them a POS. I would never deal with this guy and I will remember his name should anyone ask my opinion.

I have to say, it really sucks that anyone should have to go through this. But by this point, I would quit trying to contact him personally and go through an attorney...I gave him 2500$ in checks and about 400$ in wood and yes he has made me nothing. I emailed him 4 times today alone and nothing. No response. He obviously is to good to build me an instument or pay me back. He put me off way past our agreed finish date. I took a lot of his crap before I started going off on him.
I think it's good advice. I'm going to give it another week or so. If I don't get something from him I'll go in another direction. Right now he is being tried in the public court of opinion. He lives far away from the jurisdiction he'd be required to file. Cost of travel and court fees make it perhaps difficult to justify especially considering a judgement does not guarantee payment...it could wind up costing more money to extract the judgement. However, if it were me, I would pursue it on principal alone just to put the mark on the guys record.Is there a reason you're not taking this to small claims court? I may have missed something.
