Should I get an attorney?

What if you paid for shipping? Maybe a TB'r who lives where your rack is can pick it up from storage, take it to FEDX, have them pack it and you call the location and pay by credit card.

At least you'll get it back.

Are you still holding out hope they will send it back on their dime? Obviously, thats not going to happen (at least anytime soon). And the money you spend to hire an attorney would be just as well spent on shipping your gear back to you.

I havent read the entire thread but I did read the part where you said you finally talked to the singer and guitar player and they reassured you. I knew right away that was bogus and just a way to get off the phone, because if they really wanted to get your stuff back to you, sleazy manager or not, you would have it by now.
 
I feel bad for ya.... If it were just on this side of La. I might could help ya. Surely someone can pick it up for you. At least you would know it was safe. If I hear of anyone heading through West La. I will let you know.

Even if management was the ones not being helpful and the band were standup guys, they would MAKE SURE you got your rig back. Its just the right thing to do. I have played with guys (me included) that didn't take any cut of gigs to make certain things right. Don't let them off the hook. They could fix it if they wanted to. Best of luck to ya Shawn.

I just came across this thread and I am disheartened to see your gear, the tools that you used to make these people money, being withheld from you for what seems to be petty and childish reasons. Please know that if I was closer to IL or LA I would help you out in a heartbeat. I hope you get resolve on this soon and get your rack back!
 
Seems to be two issues here, getting your gear back and getting even. Sounds like you're not gonna get paid, and you're not gonna get them back for the crappy way you were treated.It sucks, but it sounds like just another day in the music business. Get in your car and go get your gear while it's in one piece. The longer it sits around, or goes out on the road, the more pieces of it are going to disappear. Good luck.

This is what I'd be doing + paying $50 each to some hairy, tatooed bikies to help you collect the gear. Fly there, hire car back, maybe.
 
you get the cops. Go to the cops with proof of ownership, and proof that they have possession of your property, and their information. They are guilty of conversion. Have the cops go with you to get the gear, and have them charged with possession of stolen property. At this point, they can be sued- before you move on this- you need to find out how much they have in assets. Tip: more than likely, they are NOT an LLC, so they are not protected as a business entity, so their personal property falls under "assets".

CONVERSION - Torts. The unlawful turning or applying the personal goods of another to the use of the taker, or of some other person than the owner; or the unlawful destroying or altering their nature.

When a party takes away or wrongfully assumes the right to goods which belong to another, it will in general be sufficient evidence of a conversion but when the original taking was lawful, as when the party found the goods, and the detention only is illegal, it is absolutely necessary to make a demand of the goods, and there must be a refusal to deliver them before the conversion will be complete. The refusal by a servant to deliver the goods entrusted to him by his master is not evidence of a conversion by his master.

The tortious taking of property is, of itself, a conversion and any intermeddling with it, or any exercise of dominion over it, subversive of the dominion of the owner or the nature of the bailment if it be bailed, is evidence of a conversion.
 
You must do this^^^Azureblue. Otherwise your only recourse will be to take some of these guys to get your gear personally

Lived in NOLA for 30+ years.
In-laws, relatives, and friends(and friendly former bandmates still performing locally a LOT) live in Covington and Mandeville. Some are now in elevated postions in the local gov arena. I'll see what I can get done.

Sounds like the manager was the one Queen wrote about in "Death on Two Legs".
