Taser misuse or proper use?

as to the signing the ticket thing.

you are not required to sign a ticket

what you ARE required to do is sign an Ibond in the case that you dont' have your ID on you. If you don't you have to go in to the station to verify your identity.
Here is direct quote from a ticket I have in front of me.

Refusal to accept and sign this citation will require that you be detained immediately and held in custody until taken to appear before a judge, when one becomes available.

New Mexico ticket, I got it a month and a few days ago while on tour. The law is pretty standard across most states.
 
being I already spoke to a union rep from chicago about it I can pretty much bet my life savings on it.

at most he'll get a paid suspension.

that's called an arraignment.

if you have a lawyer it will happen within a few hours of you getting to the courthouse.

likely something specific to your state if it's just for a speeding ticket.

In IL that's not required unless you're going more than 35 over the posted limit. That's also more than a speeding ticket ;) It borders on wreckless driving.

The cop was rude but the tazering was justified.

I bet he doesn't even get suspended. Police have a reaaaaally strong union in most jurisdictions. In Portland a couple years ago, a woman was shot and killed for a slighter higher resistance on a traffic stop and the officer involved got some paid time off then returned to the street with full rank and seniority.
 
unions are much stronger in some areas than others.

For example the option of firing the officer wouldn't even be brought up in chicago. A stricter policy would.

which in fact would be the correct solution here. If the officer acted within regulations he did nothing wrong. If people think what he did was wrong they should push for the regs to be changed.

It's specific to quite a few states. Do you know the correct law for Utah or are you merely just pulling information from Illinois? I at least came close to the state with a New Mexico speeding ticket (10 miles over.)

Unless I'm incorrectly reading the ticket, it says you will be immediately detained by a police office...

Wait, why are we arguing? I'm quite the "liberal" jock over here, but I can't help but think this guy is a complete tool. Why wouldn't he just sign the ticket? I've gotten a ticket or two that I thought was wrong. You know what? I showed up in court and got out of it! Wow, what a theory.

Oh yeah? Well, the cop that recently went ape on the kid who did nothing but pull into a train station parking lot got canned, and he didn't even assault the guy...he just ran his mouth like an idiot, and threatened the guy.

This cat can start checking the want ads. He'll be looking for a new job before the end of the month (if not the week)...guaranteed. You watch.
 
also the thing that I see justifying the tasering is simply the man's hand going in his pocket nothing more. That's enough. It's a life and death matter for the officer. The man's temper had been escalating and he was going in his pocket. If he had waited a few seconds he could have been stabbed.
 
I'm not familiar with that story, but verbal threats are a much less defensible position. Most reasonable people can look at that video and see that the officer had sufficient cause to use less lethal force. The subject reached into a pocket while a weapon was pointed at him and was clearly defiant and uncooperative. I don't believe any internal affairs or independant police review board will call that unjustifiable.

watch the video without thinking about what the news people said.

Think about what is happening at each stage of it.

for example it says "Tasered for asking why he was stopped" He was already notified why he was stopped then written a ticket. He knew why. he wasn't tasered until he failed to put his hands on his head.

Basically people are twisting the events to meet their own political agenda.
 
What some of you morons fail to realize is, there are rules and procedures to follow for EVERYONES safety. You don't get to make the rules, tough. Keep your mouth shut, be respectful, and follow requests. They have a tough enough job as it is, don't bend your rights as far as you possibly can to be difficult. That's just being a dick. Stop trying to be a goddamn victim, and be a reasonable human being. If you give the officer a reason to feel unsafe, or out of control of the situation.....you deserve to get lit up.

Judges are there for a reason, these are the ones you plead your case to, not the officer on the side of the road.

Also, you sign the ticket merely acknowledging that you have received the citation. Nothing more, nothing less.....and it not an admission of guilt or anything else.

Not everyone is aware of the legal ramifications of signing a ticket. Not all states require this - MINE DOES NOT. This guy might have feared that it constituted an admission of guilt, and it is clearly within his rights as a citizen to ask for clarification...but instead got his ass TASED for even merely trying to ask a question.

The cop was NOT professional, and over-reacted.

What ever happened to "protect and serve"...now it's just "abuse, and brutalize"??

Me and the other "morons" would no doubt appreciate it if you would chill out just a little bit with the flaming.

see there it is again you're deflecting the issue. Instead of seeing a man who got out of his vehicle was raising his voice to the officer and failing to put his hands up when requested you see a guy who is just trying to understand his ticket.
 
Watched it again. Wow...the cop even lies to the other cop saying he told the guy "turn around or I'm going to taser you". He gave no such warning (which, as the link I provided says, is against the law). So he's a liar, AND a lousy police officer...as well as being just a rotten human being.

No, he was ALSO questioning whether he was speeding at all, because on top of everything else, apparently the reduced speed zone hadn't even begun yet...he said quite plainly that they hadn't yet even reached the sign.

So...let's recap: Cop gives the guy an unwarranted speeding ticket, refuses to explain the circumstances surrounding the legal ramifications of signing the ticket when questioned about it, breaks the law by tasering a guy that wasn't even a threat, tasers him without a warning, as required by law, refuses to read the guy his Miranda rights, and then can be heard LYING ABOUT THE SCENARIO on the tape to another officer.

Stellar. This cop's a real winner. Go on...defend him some more.
