that's why many restaurant chains like applebee's and such have to sing their own birthday songs for people's birthdays. suppposedly the rights of the happy birthday song are owned by two elderly women.

The venues pay licensing fees so that the bands that play there can play covers........technically if you play a cover without *somebody* paying a licensing fee (or permission from artist) it IS illegal :)......

I'm with the "why is tab illegal" crowd myself.......as long as no one is selling the tabs, half of em are wrong anyway....no prob with me :)

This is an important bit of information that many people don't know or overlook. The only reason we are able to play covers in bars or elsewhere is because the venue has the legal responsibility to pay the royalties. Now, I can't say they always do it, but the law shifts the burden from the artist to the venue, thank goodness.

Tabs are seen as akin to sheet music, which is copyrighted by the original author or owner of the copyright. That is why the RIAA cares and why tabs are considered illegal. Even if we devise our own tabs of copyrighted material, it is still considered a violation of copyrighted material.

Granted, it has been a few years since I practiced copyright law, but I'm pretty sure this is still all correct.

I agree 100%. Tabs for the most part should never be copyright infringement because 99% of the time they are not correct. They are a starting point for someone with a good ear, but unless the tabs are ultimately correct nobody is infringing on copyright!! When I lived in Japan while in the Army Band you could buy actual books with the music as well as tab written in them. That's how I learned much the correct Rush bass lines. Now those tabs were absolutely correct, but the books weren't cheap either...:D

If you actually put together a tab book for your buddy and tried to charge them ....that might start to get sketchy...:p

I would gladly pay a small subscription fee (say $20 a year more or less) for a TAB site with correct TABs that I could "legally look at and play from."

I know there are sites like BassCamera.com that have lessons and TABs, but I'd like to see an MXTabs-like site with tons of TABs that are correct and readily available.
