The UPS Store has "lost" my bass!

No offense, but did you read the entire thread?

I've been talking to UPS this week. So far, they have offered me a significant amount of free shipping, and I've gotten a written apology from the store owner. I think that's about all the satisfaction I'll be getting from UPS, which is OK by me.
not at the time of posting the reply. I see now. Sorry about that. I have stayed up all night and only read here and there. My wrong. :ninja::hiding:
 
This is a derail, but I am curious why it's not admissible.

It may or may not be - in some states both parties have to be aware of a recording being made for it to be legal. In some states only one party.

If he is in Tennessee, as his profile seems to indicate - it would be admissible as Tennessee is a "one-party" consent state.


A person who is a party to a wire, oral, or electronic communication, or who has obtained the consent of at least one party, can lawfully record a communication and divulge the contents of the recorded conversation unless he has a criminal or tortious purpose. Tenn. Code Ann. § 39-13-601. Violations are punishable as felonies with jail sentences of between two and 12 years and fines not to exceed $5,000. Tenn. Code Ann. §§ 39-13-602, 40-35-111.

What strange language.... One would imagine that "a person" would always give consent, meaning that the "at least one party" clause is moot. Unless, of course, the "one party" restriction means one party besides the person making the recording????

No one party means one person involved in the conversation. Which means you. The OP has already said it is legal in his state to record conversations in with only one part being aware, so he is the party so he's ok. But it would be illegal to tape your roommate's conversation with his pal Bubba if you aren't involved in the conversation.

Remember the whole Monica Lewinsky scandal? Linda Tripp got in trouble for illegally recording the conversation without Monica Lewinsky knowing; however if she would have recorded the conversation one state over it would have been completely legal. Sorry but I can't think of the state off the top of my head she was in, but I know she was really close to the border of one state thats was legal in.

Trip was in Maryland, and Lewinsky was in DC.

This article explains it pretty well, though it notes the confusion when calls cross state lines. According to this, only 12 US states require two-party consent. Including Illinois, where I live.
