With regards to the headstock, there was a tread recently about ugly and nice headstocks and some people commented on the fact that they thought they were ugly, some said they liked them. Myself, I'm not sure. THe builder (his name escapes me) even said that has has refused sales when the purchaser requested a redesigned headstock.
But astethics aside, I think that there is a place for a 38" scale. It might not be for everybody, but it is nice that there is someone out there building them and, although the debate about the correlation between scale lenght and clear sounding B string is not yet settled, one could imagine a powerful B string on it.
