5 years later - am I wrong?

Tough call... It's part of the reason I keep MY gear with ME. Any gear loaned / left in the custody of another gets signed for, literally. A simple form. "I (Insert person with custody) acknowledge and agree that I am taking possession and responsibility for (Insert description of property and any serial #s if available) from (Your name) on this that or the other date. I agree to return above listed property upon request.

Done.

Having said that, maybe if you catch the guy at one of his gigs he MIGHT respond favorably to returning your property, but if he's been blowing you off so far, I don't hold a whole lot of hope for this guy not being a Feminine Hygeine product one might use on a Summers Eve...

I've got to ask, why did you not drive over to the guys house as soon as you were kicked out of the band? You must have known when and where they practiced.

I have one of these (or a black one) with me at all times, and I use it with impunity.

For some of us, $100.00 worth of gear is a big deal. Hats off to those who can afford to drop Benjamins; I sure as hell can't.

No issue.

But, the guitarist happened to have my mic, my mic stand and a heap of cables at his house (where we rehearsed) and I never got them back.
Now I see he is back in the scene and I have photos of him using those pieces of equipment that are mine.
I have asked him to return them on numerous occasions without response.
What would you do now?

If it's possible, I'd go and see him in person to ask for your gear back. He won't be able to ignore your request if you're standing right in front of him—he'll have to give you some kind of answer. Wether or not he'll do the right thing and give you your gear back is another matter, but hopefully he will.

Band members can definitely be dicks when it comes to gear. On three different occasions I've sold gear to bandmates (two that became ex-bandmates) that I had to chase down after a year or so of "oh yeah, sorry man, I haven't forgotten about you... I'll give it to you next week, ok?" I actually had to walk one of those people to the bank machine to get my cash—I'd made it very clear that I wasn't going anywhere until I had my money. *Sheesh*... friggin' musicians...

I would have shown up in person to take my stuff back once the band fell apart. I am VERY selective about leaving cables anywhere, because I had a guitarist who would flat-out steal cables. I have likely lost 5 or 6 cables from him having them at his place and then selling them for quick money. I started marking and taking them back with me. Stands I can see, but cables and mics don't take up much space in most cases. I hate leaving gear like that around, because it's a free-for-all.

I would go to the next gig and take the mic and possibly mic stand, depending on how much it all cost. I probably wouldn't worry about the cables unless you spent a fortune on them.

I use a Heil PR35 for my vocals, so if the same situation happened to me you'd bet your bottom dollar I'd be getting it back come hell or high water.

I see both sides in this, a friend of mine had a similar (yet slightly different) situation.

He played drums in a band for a couple of years that practiced at his house. When the band broke up the frontman never came to pick up a guitar and a bass amp that they were using. It had been three years. My friend repeatedly called the singer and asked him to pick up his stuff. The guy would always say that he would and never did.

Last summer I was over the drummer's house and he told me that Bill never came for his amps. "Call him, I'll drop them off for you." So, that's what we did. Neither one of them really wanted to deal with each other anymore I'd guess. It was no big deal, when I got to Bill's house he seemed pretty embarrassed about the whole thing.

I saw one reasonable response.. I would either show up to his place or next gig and make a point to ask if it's your stuff remind him it is yours and you tried getting in touch with him several times to get it and you would like it back and if he gets angry just walk away. I personally would never ever want a vocal mic back full of mouth juice and sweat..57 mic is a beater mic but a good one we use them for practice. I have left gear places but just wrote it off and I have also had guys leave crap at my place and well after a good bit of time goes by less than a year I'm giving it to someone who needs it or I'll use it unless they come for it...either way they sound like ---holes so --ck em

Even though it seems like the equipment may be yours, how can you tell one 57 or cable or mic stand from millions in existence?

Let it go. Life is to short to worry about these items. To think negative thoughts much less revenge over something you ultimately had control over is only going to bring you down. It is to easy to get consumed by such things and it leads nowhere.

One time I sold a magneto for a vintage Harley to someone (by coincidence he was in Australia) it was the early days of PayPal and I hit cancel instead of accept. $410! This was after I had shipped it. He kept promising me that he would resend. Eventually I stopped hearing from him. I chalked it up to my stupidity, live and learn and all that. Like someone said already "karma's a b**ch!" Hope he didn't crash the bike he put it on or something. That is what I would worry about if I had done the same.

If he gives them back, the mics will have spent time in his pants. I'd let it go, it's been this long and you haven't needed them so it's probably not worth the confrontation. You can go to his house, but then you risk the shotgun / castle doctrine.

The Band that I was in roughly a month ago broke up. They moved all the stuff around into piles labeled who's was who's.
In the end, I lost a XLR cable. Ultimately, I'm not gonna fret about, rather not see them in fact.
In your case, either let it go, or take it back.

or send him a bill, 5 years mic rental at $2 per day = $3,650 AMEX and VISA accepted.

or at their next gig "Hi we're XXXX, a one a two a one two thr..."GIVE ME BACK MY FAR KING MIC!"keep yelling this non stop for the whole gig hehe
