It wasn't in use. You put it down. You don't own it. I have never been to a guitar store that didn't have at least a couple guitars or basses plugged into an amp just sitting there. Sorry, but it's far worse behavior to think that anything you were playing is automatically yours even after you put it down.

What about when someone alone at a crowded bar, with nobody to watch his stuff, has to go to the bathroom. Is he not entitled to get his seat back?

Except he wouldn't have gone to the bathroom in that metaphor if it were to be analagous- he would have gone to sit in a different seat. Of course someone would have taken the seat he left.
