Ebay woes

Fair enough, though I try to avoid leaving neg. feedback whenever possible. Even when the seller's a real POS I often just don't leave feedback at all. I figure as long as I get my refund and if its a grey area at all I just let it go. If the seller is especially horrible though I might leave a neg. to warn others.

In this case I guess it could go either way. On the one hand, I'll give the seller the benefit of the doubt that he wasn't intentionally trying to screw anyone over. He might just be one of those people who isn't careful with his stuff and either didn't think a few dings were worth mentioning or simply didn't notice them. I know a few people like that. On the other hand, the guy was being shady about acknowledging the damage and then the delayed refund thing so yeah... But hey, at least you'll get your money eventually.

Yeah. I actually think that this is the first negative I have left for someone. I don't leave negatives if something went wrong but the seller tried to fix it. I was giving him the benefit of the doubt at first, but the more he spoke, the more lies came. He outright lied. He said that "there is no damage or wear" and when I told him about the damage, he said that he looked over it carefully before shipping (how can you miss the damage near the neck and that big stain?). Also he said in one of his messages, that the guitar spent its whole life in the factory box in the closet, which couldn't have been true. So I left a negative so that people will be more careful about the seller. I noticed that he has another guitar (that was recently listed) as "new (other)" and has sold other stuff as "new (other)". So I don't think he accidentally chose "new (other)" and knows he can get more if it's listed that way.

Yeah, If the guy picks "new (other)" because he thinks his used gear is just in really nice shape, then he's doing it wrong. That category is for things like floor models that have never been purchased by someone and still have the factory warranty, but might not be in perfect condition or have all the original packaging.

Not sure if you read the whole thread or not, but the number one thing is that it wasn't listed as "used" or "near new". It was listed as "new". To me that is a big deal. The pictures didn't even show the damage or staining. That is also a big deal. If someone is the type of seller who doesn't show the obvious staining or damage, then I think that seller deserves a negative rating. As soon as I opened the box, I could see the staining and damage, so it wasn't even like someone just didnt notice it.

If it was listed as "used" or even if his text said "near new" instead of "pristine" and "unused", then he would not have gotten a negative rating.

I have bought a guitar that were stored properly that sat in a closet for years and I would have considered them "new (other)" which was how this bass was listed. That guitar was bought by somebody who bought it for a family member or something. So the guitar was never played. That is the kind of guitar that should be listed as "new (other)". This one shouldn't have been listed as new (other). So I do know for a fact that you can buy a "new (other)" guitar on ebay and it is actually as listed.

If he had refused a refund or to make the deal right, then EBay and Pay Pal would have gotten involved to resolve your issue. It's a matter that I have sold tons of gear on EBay and I always looked at a negative rating as a last resort if the transaction wasn't resolved to your satisfaction. Call me old fashioned (actually just old), but I always like to give the benefit of the doubt when a refund has been made. To each his own. At any rate I hope you find the bass you are looking for without any further hassle.

Like I said in this thread, I wanted to give him the benefit of the doubt, but he kept lying even when caught in a lie.

Reasons I gave him a negative rating:
  1. When I first messaged him about the staining damage, he insisted that he never used it and it spent its whole life in the factory box.
  2. When I sent him pictures of the staining and damage, He insisted that he looked over the bass carefully and did not see those there. Which is weird since I didn't have to look at it carefully to see the ding and staining. The staining looks like it's been there for a while
  3. His ad was full of lies, such as that it was so new he didn't even take off the plastic protective covering on the pickguard. The plastic was gone when I received it. (There is no gray area with this. Either the plastic protection is there or not).
  4. He did not admit that he either listed it incorrectly or he just made a mistake or lied, but instead tried to blame shipping or that they were regular Mexican finishing flaws.
  5. When I asked for a refund, he insisted that the guitar was brand new when he shipped it out, then threatened not to refund me if he didn't get it back in the same condition that he shipped it out in (which means in brand new condition).
  6. I have emailed him several times to ask questions or to give him curtesy emails about when to expect the bass, or to let him know a delivery attempt was made in case he wasn't watching out for the package. But he hasn't sent one message since then.
  7. When he gave me a refund, he did it through echeck, which means I have to wait a while for it to clear. He did not send an immediate refund. What if this $400 was the difference between being late on a bill or not? I know immediate refunds exist because I have done it before.
  8. He has shown no remorse for what he has done, or admitted he lied, or even admitted he just made a mistake and just forgot that it was used, and forgot to look over the bass when shipping it when he specifically told me that he did.
  9. If he just said sorry and admittied it was his fault, I wouldn't have given a negative rating.
He does not seem to show regret and show that he has changed, because after he sent the refund, he listed another item as "new (other)". So he is going to do this again and again as long as he is thinks he can get away with it. I wouldn't be surprised if he lists the bass that he sold me using the old pictures and the exact same text in the ad. and that's exactly why a negative is warranted. The seller is not a nice one... you found out, now you can warn others.

I think you were justified in leaving the negative feedback. You had more than enough reason, even though he issued a refund.

I've had negative feedback given for me as a seller for ridiculous reasons. I once sold a men's suit that was only worn once and never altered or cleaned, but the buyer left me negative feedback because it didn't fit him well. Seriously. The only reason i got to keep the money was due to Ebay's rules about clothing (seller isn't responsible for fit issues). But he still left negative.
 
I’d like to suggest that CL feedback on sellers is no place to be overly kind or harsh. Neither guides prospective future buyers well, which is the sole purpose of feedback, is it not? I mean, it’s not like we're trying to develop a CL friendship — or are we? Simply honest, balanced and straightforward commentary is best. Otherwise, one is enabling fraud, and that’s what misrepresentation is.
 
Anyway, yes, I agree that we should be able to sue an individual for fraud who had the nerve to leave a negative feedback against us. How dare they have the audacity to offend my perception of myself as a noble, honest, seller/buyer, therefore misrepresenting to others how I wish for them to perceive my fabricated nature?

We already live in the most litigious society known to man, one might as well be able to willy nilly sue another because they got their feelings hurt.

The post above mine offers a tidbit about fraud. And, yes, a fraudulent negative feedback is never a good idea, and to stick with the facts of the case is sound advice. There are plenty of cases, mostly frivolous, where the buyer/seller is sued for libel/slander, etc. But, it's all a slippery slope, and at what point do we draw the line?
We live in society of safe spaces, crying zones, frivolous accountability, gender neutral terms, etc. If someone gets their feelings hurt, well, then someone must pay for that infraction. So, while leaving negative feedback is not likely to get you sued, it is possible. Sites literally offer advice on how not to get sued. In my opinion, we absolutely are living the dystopian present that was presented to the future generations from those living in the past......to a certain degree anyway.
