Musicians Relief Fund........two years and counting

i've been following this thread but am not directly involved. i would like to make a suggestion. if any funds are still available, make a donation to a charity like

at least then, some kids will be the beneficiary of the funds and we, well those who contributed will get to help kids get instruments. just my .02.
 
When Paul made the hard decision not to allow charitable solicitation on Talkbass, it was not because he didn't want to help pepole. It was due to concerns about accountability and traceability. Mike Winnen disagreed with this decision and made his feelings well known. Ironically, it is a lack of accountability and traceability from Mike which has brought on this debacle.

Maybe, in retrospect, not so ironic.

I was not directly involved because almost every post I saw from BMW (including his debacle with Schroeder) was so over dramatic it made my "BS" alarm go off. :hmm:

Yes. I gave BMW the benefit of the doubt, though, but only $20 worth.
 
Sadly, it looks like we'll never get this money back. Regardless of whether these funds are ever recovered, Mike Winnen is now banned from this site. We did not want to do this until he had a final chance to respond. He has had that final chance, and for whatever reasons he has chosen to stay silent.

fyi, I would love to see the remaining money sent to some organization or charity that helps needy children (cancer or any other illness, abuse/neglect, homeless, etc.).......

Children are our future.

Perhaps someone could post a poll or something? For a variety of reasons, I don't want to be too directly responsible for choosing who gets the money. But whomever we choose, I will ensure that the remaining balance gets to them, and I will attempt to get documentation of the entire transaction.

I am stupid crazy busy right now, but I will try to get that foundation fully dissolved as soon as possible. Once this is done, I'll know just how much money we have left.

FWIW....my thoughts are to St.Judes in Adrian Garcia's name.
At least someone from TB could put a positive cap on this, and Adrian was always able to do that.

But I +1 the poll that Tom suggested as to keep this open and fair.

Awesome idea, Mike! Adrian left quite a legacy here, and this would certainly be a fitting and appropriate tribute (IMHO, of course).

+1...this would be a fitting tribute.
 
While I think donating to a good cause in Adrian's name would be great, I also think we should HEAVILY consider donating the rest to Jeffbass, where the money was supposed to go before BMW dissapeared.

Great suggestion. I can think of no better place for it to go, and especially if it's in Adrian Garcia's name.

I still can't believe that BMW didn't have the balls to man up and take responsibility for this. Oh well, I guess his true colors showed through in the end.:scowl:
 
i have one conclusion. it seems that the man that wouldn't account for all the generous peoples money, brought some serious bad karma unto his family. I feel sorry for his family, it would be much better suited him out on the streets after this mess.

I wouldn't wish anything bad on anyone's family...but this situation was definately a mishandled mess by BMW...and a little cooperation would have gone a long way in him showing that his heart was in the right place initially...but he refused, and as such, burned a lot of bridges here...

As was also mentioned above, I too have read several of his posts in other threads, where he was very condescending and sometimes just down right rude to others...almost sounding like a bully...Maybe I just read them wrong...i dunno...

This is a small world...and TB members are all over it...This won't go away soon...
 
The AFM is helping musicians in the Gulf Coast who have had problems during the storms. The fund was started after Katrina and helped many musicians, union and non-union. It is a 501c3 and donations are tax deductible ([Invalid or Expired Link Removed]). All proceeds go to the musicians in the impacted regions.

I'm not sure its a great idea to be making threats of defamation or suggestions to defame when the entire story is not clear. I am the first to admit it doesn't look great and there's no obvious answer as to where the money went except into Mike's pocket, but unless TB collectively (or one individual) is going to take proper action through the legal channels, I don't think its worth exposing TB or any of its users to possible legal retaliation from Mike in the unlikely event we got it wrong. For example, say Heather was sent a link to this thread and fired Mike on the basis of the thread and it turned out, despite the evidence to the contrary,that Mike did everything okay and just didn't want to talk about it. He might want to try and sue TB for loss of income etc. Not that I personally think the facts point to that explanation, but I don't think its in anyone's interest to expose themselves to a lawsuit. FWIW.

how does this get escalated?

To be honest, I really don't know. I mean presumably if they were so inclined, the donators could sue him for breach of contract (assuming they could prove it) or for conversion or some other kind of tort, but I can't imagine that the monetary loss would be worth the legal costs. I mean this thread would obviosuly serve as a warning for people searching his name, but I wouldn't want to actively start suggesting to his employers etc anything was wrong (it would be different if they did their own due dilligince). I think other than direct moral pressure on him, I really can't think of anything else (unless you are prepared to take legal action).

I suppose you could start a "Mike wheres our money" website, but again, the costs probably wouldn't be worth the result! :)

Edit: If I don't repond for a while its because I am goign out for dinner with my partner as its our anniversary tonight, but you can email me if you otherwise want to discuss specifics about anything i've said.
