old band lost my guitar. advice?

Removing them from circulation for a while so they can't screw over the next guy down the line?

We'll see Saturday. I'm going back tomorrow evening, then checking pawnshops, dropping by the guitarists house and (assuming they haven't moved yet) telling him to hand over my guitar. If they don't have it I'm filing a police report that my guitar's been stolen, then filing a claim in people's court. If they have already moved I'm finding his address and filing a claim.
On a separate but related note, a friend of theirs who's bass also got 'stolen' from the jamspace just messaged me yesterday, asking why mine and his instruments were the only ones that went missing, implying that I was the theif. I'm really getting sick of this!

Not dead. The guitarist has moved. I have no clue where to, but I talked with the vocalist who seemed surprised that I still didn't have my guitar, so hopefully he helps me out. Aside from that though, nothing can happen till I find out where he/his dad now live. Checking around at pawnshops next time I can get over there
If you can truly chalk it up to experience and be peaceful then by all means do it , there will always be bad people in your life . If you can't let it ride then do something about it , not doing something about it could bother you forever , that is the worst . My son was in a band , he left and loaned someone a very expensive vintage Gibson going out the door and , after a year and a half , gave up on getting it back . I didn't , I waited for the guy after a gig and collared him on the way to his car . I let him know I was pretty serious and would be back every night until he coughed it up AND if he involved the police I'd be back as soon as I was out of jail . It worked , it mysteriously appeared . If you can't pull this off find someone who can on your behalf . Most nasty guys in bands aren't all that nasty , if you get my drift . It's a cruel world , sometimes .
I would report it to the cops if you have the serial number of the guitar. In Australia, pawn shops have a database of all stolen gear updated continuously by the police. Pawn shops here are also strict about photo I.D for anyone pawning or selling stuff. If you have a similar system in your neck of the woods, then the minute your guitar turns up (or is discovered) in a pawn shop, it's stolen property.
If that doesn't work, you're probably out $400. In that case, I'd go and knock the bloke out - satisfaction guaranteed LOL.
I had something similar happen to me once. Not a nice feeling, but I never made that mistake again, and I'm betting you won't either. At least it wasn't an irreplaceable instrument - something vintage, or something you'd owned for 20 years.

Yeah the Dirt bag pawn your guitar to get high no doubt
check the pawn shops but report it stolen first get police report and if you find it and have serial #'s to backup your claim the pawnshop is accepting stolen property and the police will have to act on it.

Ill be home this weekend, and I'm going to try talking to them one more time. My ex is their merch girl, and as far as she knows he still has it and is just being an a$$hole and isnt giving it back cause I threatened to sue. If all else fails tgough, its police report then pawn shops.
Im over it now, and got another guitar, but it still sucks, and I could definitely use the money right now, seeing as how my amp crapped out on me

It seems like you're rolling over a little too easy. I would have filed a police report a month and a half ago. Don't even bother going through the merch girl. She's your ex and she's associated with them so why would she help you out when she's more use to them than you are right now?
Enough with this threatening to sue nonsense; that's no going to bother them, and small claims court is more trouble than it's worth anyway. Tell your ex that unless the guitar (or $400) is returned within 4 hours, you're going to the cops to report it stolen. If this clown has a criminal record, you might get lucky. If not, report it stolen and stop mucking about. Theft is theft; it's no different than if he'd stolen $400 out of your wallet.
I loaned about $650.00 worth of gear to a girl I was in a band with, and thought might have been dating. it's complicated. she had feelings for me, and I for her, but she was very bipolar, moved away taking my gear with her, when I ran into her and tried to talk about getting it back, to make a very long story short, I was chased down the street. I think I did file a police report of theft (also tried to take out a restraining order for my own personal safety), the statute of limitations has long run out, at this point I'll be happy if I never see her again, unless she's had years of therapy and come to apologise.

Why are you letting them dick you around? I do not understand why you even came here asking for help because you seem intent on getting walked over, didn't need anyone's help for that.
File a bloody police report, you can't do anything without one anyway except suck up the loss and feel crappy about yourself forever. Look how long this has been going on, you have to drop the 'trying' attitude and graduate to 'doing'. They sense your weakness and will exploit it.
Yep, the longer you stuff around, the less chance you have of seeing that gear again. This isn't one of those nebulous girlfriend/flatmate things; they stole from you, pure and simple.
If this guy had stolen cash from your wallet, would you be behaving the same way? Shop the thieving scum-bags, and don't lose a minute's sleep over it. They deserve it.

I can't believe nobody's gotten their a** whooped yet. If someone had my property and I knew where they lived I'd call the cops first, if that didn't work I'd be over there with a bat, a gun, and 3 or 4 very large friends.

I have one simple rule that has served me well during my 49 years. Do not get in a fight unless it is something worth dying for or killing for. Anything can happen in a fight. They are not choreographed like in the movies. A simple punch to the jaw and someone falls wrong and you could be sitting in a cell but hey, you weren't no punk! Violence is only the answer if you are protecting your life or a loved ones. I am no pacifist, 5 years in the Infantry and as you can see in my picture a pretty big boy, and I have used that kind of common sense to keep my buddies out of stupid bar fights.
For the OP, chalk it up as a lesson learned. For me Karma means bad things will happen to those guys without you doing anything. The best revenge is living well. Good luck.
