Should custom ordered basses be by contract?

FYI when you put a deposit on a bass with a custom builder you do have a contract, but its not necesarily a written contract. A written contract would give you certainty as to terms and obligations which would make it easier to sue if the builder breached them. However, merely because a contract is not in writing does not mean that you cannot sue on it. The problem is that you need to prove what the terms of the contract were and if you have a verbal contract it can be very difficult to do. Email exchanges between you and the builder would be good evidence of this.

Anyway, simple point is that the minute you agree to purcahse a custom bass, you do have a contract.
