Sire Marcus Miller M3 received in rough shape

My M3 is one of the very very early ones, and it has none of those issues, and weighs 8.2 pounds. You seem to have a different bridge than I do - the saddle intonation screws are at about the same height in the bridge back plate on mine, but I can lower the action until it's flat on the frets. Hmmm.

Seems they downgraded the bridge and changed wood types, going to see if I can weigh this for more accurate details. Anyone know how to tell the date of manufacture?
 
Pretty sure the new bridge is supposed to be an upgrade from the original.

Really sounds like the seller is selling returns as new - very poor form, could get them in trouble with both eBay and Sire, I would think. I've been on their mailing list for a while now, I think I'll be removing myself after this...

please forgive the type "o's" you wouldn't know it by reading my posts but I prepare legal documents for a living, this damn chemo has my brain working at partial capacity and this is the most I have typed in one day for months. Bass is my only refuge, medicine both natural and RX is not helping me. Darn near ready to route out some wood behind one of my jazz basses pick guards to lessen the weight! would have been cheaper and less hassle then this

My concern is that I found a dozen of folks who also received damaged goods labeled as new, half of those folks say they never got their refund the other half says eBay refunded their money. Seems like I have a 50 Percent chance of getting a refund. After reading the reviews I believe they are selling stock that either failed QC or was returned due to being defective. The outside box was fine but the marcus miller box was not sealed and was torn. eBay obviously has done nothing to stop this seller.

It sounds very much like you got a return either by mistake or for whatever other reason. The scratches are indicative of this.
I have ordered a few things from Pitbull before (I live in a small town so online purchases are de rigueur) , just got some strings from them - only thing I remember I had a problem with was with a cheap gig bag for an acoustic guitar. The pocket was slashed as if someone was a little too heavy with the box cutter at the warehouse. I sent them an email about it, they told me to keep the damaged bag as it would be costly for them to pay the return shipment and they would send me a new one, which they did within a week. Not the same thing as a damaged or not as advertised bass guitar of course, but other than that, didn't have a problem with any of the other stuff I ordered.

emailed them twice over two days with no response, left negative feedback then got a copied and pasted response to use return feature and once received in good condition they would refund minus restocking, well they are not going to receive it in good condition because I didn't. No response to any of my issues, just a copied and pasted canned response with two different names signed on the email.

Several complaints on eBay stating they are selling used goods and advertising as new, Also several complaints of orders being cancelled with no notification and several complaints of no response. They obviously sell several small items and deliver them to keep their eBay score high but if you look at the higher dollar transactions they are ripping people off on a regular basis.
 
I'd also contact Sire and inform them of Pitbull's shenanigans. Pitbull may be sending out the same returned item over and over again.

Years ago i bought a Motorcycle trunk from GIVI. A reputable Italian company. I received it through the US distributor in less then "New" condition. Orange-peel exterior paint, over-spray on the interior and one of the retention cords came unattached. Got an RA, sent it back and got a call from them when they got it and they said they couldn't do anything because I had repainted it. I asked how I could paint it when I only had it 1 day? They stood firm and offered to return it IF I paid shipping!
I contacted GIVI directly, sent them all the info and told them how disappointed I was and that I was going to share my experience with my international motorcycle forum (much like Talkbass only much smaller)
and within the day the US distributor called me and apologized. They said that they reviewed my complaint and discovered that the trunk WAS a return and "inadvertently" shipped to me, and that a new trunk was on it's way, and PLEASE contact them if I found anything wrong with it.

Jump through the paypal hoops. They'll look after you. I have no doubt you'll have your justice here. Rest easy. Go shopping for the next one :)
 
Ok now slow down... I frequent Pitbull Audio very often. Spent a lot of money there. They do A LOT of eBay, Amazon and other online retailing. In today's world it's more than common for someone to receive a new item, not like it and send it back. It's very possible with the large amount of online sales they do a couple items slip when returned. It's possible the "new" item may have been on the rack before it was sold to you. It's possible the "new" item was a return.

Also do you know if the bass was shipped directly from the Pitbull Audio warehouse or was it drop-shipped from Sire?

Granted, I go "in person" to their store and will recommend them to anyone. If you have a problem, make a phone call. Shane is one of the head guys and he will fix your issue.

Glad you didn’t get screwed but I did, no excuse for their lack of response , pre purchase they were sweet as pie and promptly answered questions , after junk arrived they ignore me - No Excuse for that

That would upset me as well. Again call in and ask for Shane. Have you called and spoken to anyone other just sent an email?

They do A LOT of web sales I'm not surprised you got a generic return response.

I can understand them using a canned response to handle normal "I just don't like it" returns, but this is damaged goods sold as new, their Customer Service dept. should have jumped right on it. Awaiting judgement pending resolution - I've done business with them a couple of times successfully, but I'm watching how they handle this one. Not a promising start.

i don't like waiting, but there are excuses for the lack of quick response. for all we know the customer service rep is in the hospital, stuck in an airport after his flight was cancelled or has no electricity after a storm.

have you tried calling them on the phone and talking to them directly during business hours? i often have better luck from companies that aren't quick with emails when i call them. also it appears they have live chat; if you want a virtual paper trail, you could copy/paste or screencap the chat window.

they do have some negatives, but they're a fraction of 1%, so it appears pitbull is better than most, and that well over 99% of their customers are happy with them.

Agreed. However we don't know if the item came direct from Pitbull Audio warehouse or drop-shipped from Sire. Point being yes, the OP got damaged goods. CS should be all over it. Having bought some "returns" (pedals) from Pitbull Audio they were all in tip top shape. Did the bass leave Pitbull or Sire in bad shape? We don't know that. From my experiences in store, I've seen nothing but great CS from Pitbull. Even with online chat before I've gone and picked up an item. A story like this about a place I highly recommend to people has got my interest as well.

I still stand by my statement and recommend asking for the guy I mentioned.

You've been given some good advice. Here's what I would do:

  1. Call Pitbull. Speak to someone regarding the defects. If they agree to a full refund, plus shipping, then you're done. If not, go on to step 2.
  2. File a claim via eBay / PayPal. Document the damage and your conversations with Pitbull. 99% chance you'll get your money back in full.
