So she's suing... ??!!!

First thing I notice is how low the glass is.
Second thing is that because of the glass panel you can't possibly sit on the ledge.
Now of course people could pay attention to their kids and realize the World can't be baby proof.
 
Regardless if she sat the kid on the glass to take a picture or if the kid wandered off and fell over the balcony, this highlights the fact that some events and places just don't have to have kids under a certain age coming to them. When did it seem like parents started thinking that they have to bring their under-five kid to every single place in the world?

Still a very tragic situation, regardless.
 
Endemic of the human condition for a a lot of us. Something went wrong could it be me? No, it can't be me it must be someone else's fault. In our culture we sue.
Yes this person really messed up and child lost it's life becasue of it. But we also love to point out how someone is a stupid moron who should be sterilized etc. Have you ever done anything really stupid? I have done a few things. Yes, maybe you didn't cause a child to lose it's life but you may have screwed up in a way that hurt other people.
 
Why is the legal system allowing this?

The legal system doesn't allow or disallow anything. Anyone is allowed to bring suit if they think they've been wronged.
If the suit has merit it goes forward. If it doesn't it gets quashed. In this case I think the Staples Center lawyers have already asked for a dismissal. Whether they get it is another story.

We have this idea of comparative responsibility for an accident which is based on the fact that most accidents have multiple causes. A guy crosses a street without looking and gets hit by a car that's speeding. Both are responsible for the accident.

So while the woman may have done something stupid maybe the Staples Center designed the railing poorly - didn't take industry best practices into account, should've foreseen that a railing that low is dangerous to anyone, didn't design to code or whatever and is also partially responsible.

Whether they are or aren't is what the legal system is for.

Yep, screwed up majorly a few times doing stupid stuff. No one died. BIG difference. "May have" hurt people is a possibility, dead child is a reality.
 
The world is not and never will be idiot proof or child proof.

As the father to an almost 2 year old I would have walked in to that room and said "No way, not going to happen." On that note I think that someone should sue the maker of water for all the drowning deaths that occur when parents are on cell phones. We can't actually expect the parents to take some responsibility now can we?

Last weekend we were in a backyard with a pool for 7 hours. At no point were my wife or I ever more than 3 feet from our daughter at all times. At least one of us watched her like a hawk every second. I wish I could say the same for all of the other parents.
 
Because she knows it's cheaper for the Forum to pay her off than to entertain a meaningless lawsuit with the Forum's name dragged through the papers. Though, a judge may throw this out.

50-50 Lawyers gotta like them odds.

I am saying Forum but it's something else now.

If the system is anything like here, she'd probably have to cover her own and their expenses if the lawsuit was admitted and she lost :D
