TARA Labs cable challenge!!

Not really. He knew the stated value of the goods when he recieved them. Just because he doens't think they are worth it does not mean that they aren't. Especially since they DO actually sell these cables for these prices (how, I will never know).

I understand Tim is in a tough spot, but if I was in Tara's position I probably would have already taken this to the next level. 9 months is way longer than the 90 days agreed upon and Tim unfortunately assumed responsibility for the cables.

I'm not saying he did anything intentionally worng here, but look at it from another perspective.

I have seen peoples claims here that a Sadowsky is really no better than a Fender (very arguable). So if Roger sent me a bass to try out for 90 days and I didn't return it for 9 months shoudl I just offer to send him the price of a Fender, or an SX Jazz?


Personally I would have my foot up someones ass at QSC until I got Bob on the phone and got the damn things back. IMO they aren't worth near the $ they charge for them and I certainly wouldn't want to be on the hook for them.


Tim, if you need me to track down something or someone for you, feel free to PM me. It's what I do for a living and I know there's probably no one on TB that wants this resolved more than you do. Let me know if I can help in any way.

Hey Blisshead,you are right,the cables did not come from me,but I do feel somewhat responsible simply because I got Long and Tara Labs involved in the first place.You may not know this,but I made several calls directly to Tara Labs trying to find out why it was taking sooo long to get the cables to Tim in the first place!

Tim,I had no idea that Tara Labs had sent you a bill,nor did they contact me about putting something on Talkbass about this! I,like everyone else on here,was really curious as to why we had not heard from Bob Lee,and when he didn't respond to me e-mail's and PM'S,frankly it pissed me off.

I am not bitter about how the test came out,and if some people(or a million people) don't dig their cables,that's cool,it still doesn't change my opinion of them,and I still sell tons of them!

Heck, why not? Monster's made a mint. In fact, they just bought the naming rights for Candlestick Park in San Francisco. So now, when the 49er's play home games on the tele, Monster Park is all over the screen. I can see it now, the JazzAd Collusium. It's got a ring to it. :D

Ok, but I still think it should go back to phone calls/emails/pm's and not be out here in the forums. I know you can see, people do draw their own conclusions, often erroneously.
 
Just a thought.... piecing a few things together....

This $2,000 invoice wouldn't be due and payable from a 9-mo-old "cable sale" in which the merchandise was *misrepresented* as "Made In USA", would it? :eek:

Because if the merchandise *was* misrepresented, the original invoice price becomes unenforceable..... and any attempt to collect the $2,000 constitutes fraud.... :p

You sure you got the right Monster? There's the instrument cable company and then there's the internet job site... but you did know that, right?

What kind of wrong thinking is that? I realize you're not entirely serious, but... to not follow through on an obligation is like renting a movie and not returning it because it sucked, despite all the good reviews.

No, not correct.

Of course the cables should be returned. That's the preferred resolution.

However, it has been established that Tara Labs is now trying to collect $2,000 from Tim for a cable or cables that cost no more than $14 to manufacture.

That's gouging. By any standard.

But if lawyers are getting involved to enforce the gouging, it is valid to remind them of one salient fact - that the cables were represented as "Made In USA". From the article that Mark posted,

"Such labeling could be interpreted as fraud."

When the cables were transferred to Tim's possession quite some time ago, with the backing $2,000 invoice, they were purported to be "Made In USA" (or so I'm guessing).

They apparently are not. That changes their value. That's why there are laws on the books forbidding this sort of thing.

Inaccurate movie reviews are not legal fraud. Inaccurate "country of origin" labeling is, which was the basis of the raid and seizure in the first place.

The part about "Made in the USA" may have some validity. That of course would depend on the outcome of any court action over that issue. Innocent until proven guilty and all that. Just because the feds say it's so doesn't make it so.

However, the "gouging" issue has no legal relevance. Their cost to manufacture the cable has nothing to do with the fair market value. The cost of the wod and metal in an high end bass is nowhere near what the fair market value is for the bass. What you are paying for is the manufacturing process. If they decide to build in $500 an hour of r manufacturing and another $500 per unit in R&D and engineering costs, that's their perrogative. If you choose to or not to buy it, that's yours. There is nothing illegal about charging their price for these cables.



Hell, people make a living as Pet Psychologists and sell Pet Rocks for a living. If that's not illegal, then nether is this.

Having said all that, there's no way in hell I would everr buy one of these cables. I just see a lot of bull**** justification for not returning them to their rightful owner.

+1 well said.

I don't think anyone's implying that Tim is spouting BS about not returning the cables, just that they should be returned, and that the cables were left in Tim's care- it's his responsibility to get them back regardless of who has them.
