I'd say call him...continually untill you get to talk to him, since if you e-mail he could just ignore it more easily. So talk to him and demand to know what the deal is, and what he's willing to do to make it up to you.
I think that's the best place to start, just finding out Ken's side of the story to all of this.

But you own a business, so I'm sure you already have a lawer.
I could let some things slide being slightly different than expected from a custom build, but not as many as Ken has made on a bass that ran 5k without even an offer to reconcile any faults. Thats just piss poor business ethics.

I've been through small claims and the MIch cap is 3k
and I have been through multi million dollar lawsuits too.
the truth is, he probably wont have the $$ but he did just cash $2175 from me so he should have some of that.
this bass plays really well and is comfortable as hell. its only like 1.5" thick so the cocbolo/wenge ziricote isnt heavy at all.
I like the body style too (imagine that!, My first body design is super comfy)
It desperately needs
to be.
A.) refinished with eurathane
b.) new control cavity cover made
c.) new inlay on the back (the right one)
d.) and take the existing pups out put in wood blocks that mimic the top wood as to blend. and put pups in where they should have been in the first place.
thats like just under/over a grand of work.
I will at very minimum demand that he gives me a grand back so I can have it made the way it was supposed to be.
I severly doubt that hell have the $$ to give me back and If .
A.) I lien his bank account all he has to do is close it
b.) I lien the business, it appears he dosent have any tools or anything that would auction to the tune of 5K
c.) Lien his property- well we all can imagine he lives in a shack in the woods probably wont ever sell it so I wouldnt get anything that way.
and I also SEVERLY doubt he has insurance so thats out the window too.

He's 100% hippie, and the sweetest, gentlest guy you're ever going to meet. Unfortunately, while he's pretty good at making things with his hands, I think he's pretty logistically challenged.

No one needs to send KB any email on Tribal's behalf. Do you honestly think 100 people sending an email saying "Give him back his money" is going to do anything besides let Ken claim harrassment in the off chance this thing ever sees a courtroom?

The only problem with finishing it in poly/eurathane/whatever would be buffing it out in the curves of the horns. Once you have that many corners, it's gonna be a bear to work around them with a buffer, even a small one. I think you're stuck with oil....
3,000 in small claims would be better than living with the bad mojo of a bass that didn't come out the way you ordered it. Then you could sell it for 2500 and at least not be upside-down financially with it.
You might even want to invest in a plane ticket and scoot out to LA and pay him a visit. A couple of hundred bucks is pocket change compared to how much you invested in this bass. It would be much harder for him to blow you off that way. He can ignore calls and emails, but if you're standing at his door with your jacked-up bass and a printout of all of the emails in your hands detailing your specs, he's much more likely to build you a new bass (in a timely manner) to your specs.
If I ordered linguine puttanesca with sundried tomatoes and blackened chicken and got spaghetti and meatballs, back to the kitchen it would go.

this is seriously bad reputation for this Ken bass guy because I can imagine a big chunk of his potential customer base is here looking at this thread....if not, word of mouth from your experiences.
but if he's taking the piss out of you and delivering a product which is not to your expectations then....it's fair that people should know to avoid this chap if you have a spare $5K to burn.
I personally can't ever seeing myself getting a custom bass made from scratch. I've not yet reached that level of GAS.

If it were me, this guy would get a certified letter from my attorney, threatening legal action, then an endless series of calls till I got through, and I'd tell him to make it right... right now... or else his hippie ass will end up in court, where aforementioned attorney would tear it a new you-know-what. Wow Todd, that sucks. I really don't buy into the whole "I'm broke" thing. When you're in business it doesn't matter if you have the money or not. If you fudge something you pay for it (actually this isn't a business thing, it's a moralality thing). That's a bad mentality on his part. Seems like this was doomed fromt he start. I'd be laying down an ultimatum.

This sounds like a really bad transaction, and you definitely have every right to be upset. Let's see how he responds and if he can't make it right for you.

That is B.S. man. I would definately not put up with that at all. Take him to court. The fact that he got the woods wrong is just plan stupid. There is no excuse for that at all. I would send the bass back just because of that!!! Screw him. I would never consider one of his basses now.
