If anyone were going to sue, you would think it would be the artists themselves (especially the Ace Frehley one since Gene and Paul own that trademark). But I haven't heard that being the case (but nor have I looked). But maybe they licensed the likeness from the artists?
So, if those artists sued, no doubt, the defence would be parody. And here is where it could get interesting - if those are Gibson endorsing artists, then doing a parody of the artist would necessarily include the instrument. Since parody is protected, there would be little that can be done.
On the other side, if the artist's image is licensed and they are a Gibson endorsing artist, part of what is licensed is the use of the 'signature' instrument. In which case Gibson would be in the distasteful positon of having to sue its endorsing artist for improperly sub-licensing. And suing an endorser is rarely a wise business decision.
But it maybe cheaper/easier to simply comply with the cease and desist. IANAL; just the ramblings of someone who only knows enough intellectual property law to be dangerous.
The Gibson lawyers just trying to bring in $$$$$.

I'll go out on a limb and say that either the 5/16" or the 8mm will do the job. The 8mm is only .0025" larger than the 5/16"
But, of course if it is an 8mm then the 5/16" may or may not fit being .0025" too small.
