drum rhythm
None of which should be actionable IMO. Its inevitable and logical for musicians to be influenced by music they hear that was produced by other musicians. I think only cases of blatant copying should be considered. I dont think this comes anywhere near to qualifying as that.

Really? Nobody else hears that? Same rhythm guitar, same background, same groove, same melodic elements? Maybe not 100%, but that's awfully close to be coincidental. Were I that crappy band, I would also consider that stolen work.
You guys saying they don't sound the same must be listening to something else... Those could practically be 2 takes for the same song using different lyrics.
The rhythms are near identical aside from a few random things. Like has been said tons of pop music sounds the same so its not like this should surprise anyone.
Bassline's different. Chords are different. Melody's different. NOTHING the same other than the most basic of guitar riffs...that has been used and used and used ad infinity....You guys saying they don't sound the same must be listening to something else...
