Beware Fodera's "certified pre-owned" web page and consignment deals

What did Joey say when you talked to him about it? What did Vinnie say?

Robert, you still haven't answered this question. What did Joey and /or Vinnie say about this?
 
At that point, I called & talked to Joey to ask if he knew what had gone on with the bass. He said he did not, except that he knew the money "Mike" had sent me - the $6200 - had come directly out of his own pocket, and that none of the profit from the bass ever went into Fodera's account either.

Joey also said that he guessed Mike probably considered the bass to be his after he sent me the money, and that he was therefore free to do whatever he wanted with it.

Yes, I saw that, I meant was this his responce to the whole, "I should get 80% of $12,000" issue.

At no point did the status of the transaction ever legitimately (with mutual knowledge and agreement) transition from "Consignment deal for Robert" to "personal investment opportunity for 'Mike'". For that to have legimately occurred, I would've had to have at the very least known what was happening, being the seller, but I didn't. It's clear that after researching & discovering the details about my bass, it was "Mike's" intention to keep that info close to his chest, and get me out of the picture by paying me off, so that he could maximize his own profit on the deal. And to me, that is wrong".

He then said that after this, none of them will respond to him.

Mike could do whatever he wanted does not sound like they think Robert is owed anything.

This part is particulary interesting to me in that you would think that if Robert got a personal check from "Mike" he would have mentioned that as it would have been a curiousity, but instead got a check from I'm assuming Fodera which would seem to indicate they("Mike" and Fodera) at the very least had a conversation about the money(cash exchanged or deposited into an account) and what it was for.

Why would you assume that he got a check from Fodera just because it wasn't stated that it was a personal check from Mike? He says that Joey told him the money came from Mikes pocket and that it made sense whay it took a few weeks to get. He also says that Fodera made no profit. If Fodera paid him out of their account, I don't think it would've taken a few weeks.
These are the kind of details (or "holes" as some may call them) that I like to hear before making a judgement on a company that has been very credible. Maybe I am wrong.
 
If Fodera's Mike did a payoff there isn't any consigning in this deal correct?

that is half of my question here, without a lot particulars being thrown around and also the prequel 'I don't know a lot about things' statement, I am not sure if 6200 is valid for a sale or if there was any sort of hard line that it had to be consigned. Where does it state in this that falling outside of a consignment deal is a bad thing? ESPECIALLY if the owner set an expectation up front (yes it does say a value was discussed)?

No, it wouldn't have been fair to say there is a straight consignment going on here, if that was completley the guidelines of the transation then shim sham has occurred. At the same time if 'are you looking for about 6200' was discussed (which looks like it might have been), and then the line 'cool I'll get you 6200', however it may have been phrased, I don't see what the issue is. Regardless, from the time it was agreed to have sold to the time the guy actually got a check, which was proceeded to be cashed, a lot of things could have went down. It was 'mikes' call to flat out say it sold, and you'll get your money, and as far as I can tell, expectations were completely met.

but once again, all of this has been said I suppose. we'll never have a clear answer, and I still stand where I stood previously, as it seems everyone else is still firm on their stance. no biggie, just a lot of arm chair quarterbacks! ;) cept this is not a sport....
 
There's something fishy about Fodera's salesman. I called them myself inquiring about the basses that they have for sale on the website. One is a Essence Series Imperial Elite 5, brand new. The other one is another Imperial Elite 5, pre owned.

Me: Hi, I'm calling regarding this brand new Imperial that you have for sale.

Guy: Oh, sorry, I sold it few hours ago.

Me: How much?

Guy: $7500, but we have another one that you can see on the site at the pre-owned section.

Me: I see, how much?

Guy: $13500

Me: How come?

Guy: It's a special bass made of some older woods and blah, blah, blah.

Did he buy this bass for 6500 and is selling for 13500? I don't know, but doesn't smell so good...
 
Welcome to Brooklyn and high end boutique gear. Without any consignment agreement? Suck it up. (I dont see why y'all dump that kind of coin on an axe anyhow. Dont make ya play like Vic.)

Small claims, better off buying a plane ticket and telling Mike ur coming to kick his ass for $5000. Brooklyn style. When he'd least expect it. "Send me a check, or I'm coming to play ************.."

Me, I would've called a good bud, one of "NY's Finest", and had the boyz talk to Mike. That's how we do things in Brooklyn. ( cuase kicking his tail inside out get us in jail)

But truly, Joey is not that much at fault. And not legally at all. Sounds like he lets "Mike" run his own profit center. Porlly not a good biz decision in teh high end bass industry, as evidenced by this thread.
