Gibson refuses prize winnings

He came back and requested $13,000 worth of Gibson gear. It was a whole list of stuff. They said, that's more than 10K - You gotta pick 10K worth of Gibson gear. He changes up his order to a single item that wasn't on the original list. The Gibson rep, who admitted from the beginning that he is fairly new to his position, is probably just about as confused as can be by now. Then the guy goes over his head and has somebody come down on him a bit. Now the rep says he should go through that other guy - the guy that he's already gone through when he went over his head.

I read the story, and it really sounds like the prize winner has behaved like a true PITA and is now slandering Gibson publicly. What a jerk. I really don't see any problems on Gibson's end.

I'm not sure you really read the winner's blog about the situation.

When he asks about the Baldwin, Don Pitts replies, "Baldwin is the only division that’s not part of the deal…but…maybe I can ask…Was(sic) you looking at the 243 (piano model)?" EVEN the rep didn't find it odd for the winner to ask for items from Gibson's other divisions.

The guy from Lollapalooza was just trying to help. He didn't even work for Gibson.

The winner mentions in his blog how he waited about a year before going public. That's pretty effin' patient.

I went to the Gibson Products web page: [Invalid or Expired Link Removed]

The navigation bar on the left side of that page lists the "Gibson Family of Products." The seventh item on the list is "[Invalid or Expired Link Removed]." Clicking that link takes you to a page on the Gibson site, with the Gibson banner, that describes Baldwin pianos. Given that Gibson itself considers Baldwin pianos to be part of the "Gibson Family of Products," the fact that he selected a piano does not appear to be unreasonable.

Would you have found his behavior to be unreasonable if his initial prize selection was $10,000 of Epiphone guitars?

Incidentally, I also spent a fair amount of time Googling for a link to the contest rules, but wasn't able to find one. I think that it would be interesting to read the rules to see exactly what they had to say.

I will not apologize simply because I have a differing opinion. Even if my opinion differs from every other person that posted in this thread. I think that you are all missing MY point - that is, that you are responding after hearing ONE SIDE of a story. Don't you all know that there is 3 sides to every story? His side, my side, and the truth which lies somewhere in between. If you feel that you know the truth about what is up after reading one persons side of a story, more power to you. I'm glad that judges in our legal system do not work like you guys do. When I read through this guys side of the story, there is enough holes in his story to make me question if there was any wrong doing on the part of Gibson, or if this guy is just a PITA to deal with. I listed several things in my previous posts that this guy is simply in the wrong about, and that leads me to believe that this guy is in fact just a PITA to deal with, and Gibson very well may be doing there best to do the right thing. This is my opinion. I don't care if I'm in a minority. I'm right and you are all wrong. So what? I already knew I was smarter than the rest of you.

Did you read the part of his blog where he mentions that he considered legal action, but chose not to because he probably couldn't AFFORD it???

With all due respect, every time you post in this thread, it becomes more and more clear that you have let your emotions(and whatever preconcieved notions) cloud any any objectivity.

I realize that we may not have all of the details, but you haven't even GRASPED the details presented.

I know that contests are tightly controlled in Australia, and therefore actually getting the prizes isn't that difficult. The rules, terms and conditions of competitions and prizes must also be very clearly stated.

However, what in real terms is the legal process? If it costs a goodly amount just to get a letter sent from a lawyer, and he doesn't have a lot of money, according to the blog, it may not be worth it. I know I would certainly take a long look at doing it as after taxes, sale of goods to fund wanted items etc, it could quickly become a zero win situation.
Just playing devil's advocate.

No, he didn't ever change his order to the mandolin. He was going to make that change, in the midst of his poor communication with Don, but that change was never received. He had Kevin (lollapalooza) go over Don's (Gibson) head. Now he's dealing with Kevin. Kevin came back with the original "piece meal" list of guitars and stuff. At this point, if he was really wanting the mandolin he could have changed his order to the mandolin through Kevin. He didn't. He chose $10,000 worth of stuff from the original list and that is his official order. I'm paying attention.

Remember, he complained to Kevin about Don. Kevin is making sure that Don does right, and he should deal with Kevin.

It’s been a few months since I even bothered to contact anyone. The last few times I contacted the Lollapalooza folks, they always seem surprised that I hadn’t received anything yet. I’ve realized that it’s basically useless to complain to them anymore, because it’s clear that they’re still dealing with Don Pitts. I’ve even tried calling him myself and no one answers. (Surprise!).

If he wants it resolved, you don't back off. You call every other day. I read the story, I know that he's wasting his time calling Don and he needs to call Kevin. He needs to not let it go and stop communicating, but rather to stay on top of it - working with Kevin, not Don. If it was me, I'd have my stuff or know when it was coming.


This blogger handles things poorly from his end and really contributes to the F'd up situations he finds himself in, then he makes himself out to be martyr. I'm surprised I'm the only one who sees it. This guys a drama queen.
