Look Chauncey - nothing personal, but I don't know you from Adam and I'm not painting you as anything. I only input to this thread because I hate seeing someone (anyone) getting screwed. So I only offer support and advise, like everyone else. And here's some more - the only way you'll ever get any real satisfaction is by staying cool and calm. Record ever transaction, note every attempt at communications - things you are already doing probably. And spend less time on tb and more doing your homework. Short and sweet - it's time to deal with it.

Hey! Your right! It was also probably a step too far with the immigration thing. I regret saying it. I'm just so pissed, and I didn't take it personal,I just don't want anyone to think I'm a biggot. Tomorrow im calling the police and yes I have a lot of recorded attempts trying to call him. Every time I think this is coming to an end I just hit another wall.

The point is to stay focused on the goal w/o diluting it with vindictive or 'payback' mentality. Go through the proper, legal channels and do it by the book. Don't call anybody until you talk to a law professional. Yes, you will need to spend money so spend it wisely. But having said that, there are 'call in' programs on the radio or citizen protection agencies that may offer help w/o pay. Either way, be prepared to act only after you have educated yourself to all your options that the law allows you. Don't just lash out or make random calls - it's more about knowing exactly who to call, who to ask for and how to speak. In my opinion having a lawyer call instead of you will get you much further and more directly to the point.

Treat this as a serious matter and don't assume your naivety will get you sympathy. This is biz, money and the law. If you want to take action - you'll wast your time and energy if you don't seek legal advise 1st.

Cool! I'm looking up Tennessee law now and I take your advise seriously. Never done this before but it does seem like every time I make a mistake that I learn something. Not to mention this thread doubles in size. I can admit to being ignorant, vindictive, just not racist. I will consider what you said greatly and act tomorrow after further research.
 
ya! That sound about right. He's not a business that pays a lot of sales tax like a bar or a gas station though. Maybe they get him sent back to Poland.

I don't think that a Chamber of Commerce is really equipped to handle consumer complaints...in my experience it's just not something they do, I don't suppose it would hurt, other than the pain of wasting your time. Then again, I could be wrong...maybe some of these organizations are set up to help consumer.
The BBB might be a better choice, but again, think about who pays the bills there - any group run by businesses isn't a great choice for taking the consumer's side.
 
Your probably right. I'm not a racist and don't hate anybody because of ethnicity or skin color or sexuality so don't paint me with that brush. Also I was married to an imigrant. Got nothing against anybody, except this guy.
If you need the name of a good Polish luthier.... ...I've got 2 Krysztof Kanias that I think very highly of.

Yes, Chauncey placed an order with me for a very custom guitar and placed and by placing an order I mean sending random checks for a while claiming that he should be ready to pay for it sometime by the and of a summer. We started to talk around February. Now he's talking about me giving him a run.
After me trying to please him and make designs even building a real mock-up wooden guitar just to email him photos, drawings by the time I was about to start putting the instrument together he said I don't want it anymore! BTW that was end of the "Summer".
The wood that you're referring as damaged - he send me a piece of Rosewood with a nut and big swirl saying to make it work laminating with maybe some Purpleheart and always wanted my input in the construction. Since the fingerboard suppose to be a Birdseye Maple I thought of laminating some of it in to the neck as I've done many times before and always sounded great and looked stunning, also It was the nice way to use best parts of the Rosewood block.
He is the one that broke the deal and whatever the real reason I'm keeping the deposit for the work I've already done and It was plenty extra things I've done on the top of the standard deal!
One more thing, after We had some email exchange and him being really aggressive, vulgar and disrespectful (and I should use stronger language) I've actually had an Idea to pay him back on my terms contrary to what I was believing should be done. He immediately made the Video and plastered all over the Internet also commenting everywhere he can as you know using bad language and plainly harassing, threatening and terrorizing me!
At this point the next thing is hiring the Attorney to shut him up and some if have to!
I hope you have a better view on this situation now and I'm sorry It had to come to this stage.
I still don't get the real reason of for this and probably I never will but this guy is a punk and thinks that intimidation technique he's using will get him something but the truth and fortunately law is on my side.

I'll be writing an email to wooten woods tomorrow. After I calm down.

I'm not sure what writing a letter to Wooten Woods will do. Vic does not endorse Rybski, he endorses Fodera. Vic also does not administer his camp... he has a team for that. Finally, the best he could do is say "I'm sorry you experienced this, I hope you can work this out."

I doubt he'll get involved in any way.

Really? That seems a little steep to me, given that progress to date seems to be a neck blank and a ruined body blank. Yeah, he deserves something for his efforts, but full price for no product? I don't think so...

Well here is something I can reply to. So he was going to pay me back right but he changed his mind, how convenient! I'm sorry but you can't keep my money and not fulfill the contract. He blew me off in August after he gave me the impression that he started to tell me he's now building my instrument, just for me to find out mid November that you have not done one thing and have been blowing me off the whole time. I could of left freezing wisconsin a month earlier if he just told me the truth. The last time I tried to get a hold of him before I asked for my money back it took him two weeks and two emails just for him to tell me that he had done nothing. I asked him not to make me a mock up and had no problem that he switched wood and number of frets. He had to ask me the scale length again after 7 months. He clearly lost my order or part of it but I didn't even care until he blew me completely off. He could not build me a guitar for some reason, whatever that reson was. Why would you tell someone your building there instrument twice and then not build there instrument. He could have been honest with me, I would not have had to wait around in freezing hell wondering if I was getting ripped off or if dude just didn't have the respect to tell me when he actually was going to build me a guitar. He calls me a punk. I'd smack the dentures right out dudes mouth.

Personally, I'd be inclined to pay half back, at least... but on the flip side, the best business is the business you don't do so I'd pay back the full amount and be done with it.

The guy put me off for months! He has a turnaround of 8-12 weeks. He put me off for nine months. The thing that really got me was he actually told me he was building my instrument. Twice.

  2. Did the contract cover services to be rendered and timeline?
Rybski claims that you (Chauncey) sent random checks as a deposit. Without a written contract he can claim work was performed (for the mockup etc.) and charge you for his time.

This absolutely could stand up in a court of law especially without a written contract.

Sorry to be the bearer of bad opinions.
 
He only told me he was going to pay me back to stall me. Just like he told me he was building my instrument, to put me off. I didn't make a big deal about the neck wood at all until after, but what's a custom instrument if the guy does not follow your order. Twice I told him that all three big lams have to be rosewood. He completely wreck that expensive piece of reedwood. He did this on purpose. Rybski also got plenty of time to defend himself and his bussines.

Hey. The contract is verbal through email and it is legaly binding the second he cashed a check. I asked him not to do a mock up and told him to make the drawing. I told him he could play with the shape only if he wanted to.
