Should people go to prison for filing false rape cases?

I think someone who falsely claims rape should get some jail time as they are guilty of a crime that could ruin someone's life.

How is it different from falsely reporting somebody for any other crime? I don't see the problem here. You can be accused of any multitude of crimes; but you are innocent until proven guilty in every case. Rape accusations don't carry a special 'instantly guilty' weighting out with teen dramas where girls try a teacher in trouble for giving them a poor mark or something... which is the sort of sad fantasy land that this thread seems to be dwelling in for some odd reason (perhaps some guys are worried about past actions or something...there is something to consider).

Is it that people here think that;

1) Guys are getting chucked in prison on the weakest and most tenuous of evidence in any rape case with a troubling frequency...

or...

2) People making false rape claims are able to do so with out facing any repercussions at all.

There isn't some weird feminist Kangaroo court whereby screeds of honest dudes are getting thrown in jail every week, as much as some would love to imagine otherwise.

Short of men's rights fan fiction on the Internet, I fail to see any evidence that backs up either argument above. There have been SOME cases of false rape claims, and each time it is treated on a case by case basis JUST LIKE ANY OTHER CRIME.

A rape victim has to testify in court and be cross-examined, outlining their attack in stark detail for the benefit of the jury. Furthermore, the vast majority of rape victims know their attackers, so that makes it an even more harrowing experience. They have to testify against a family member/loved one/person in a trusted position AND detail a violent attack against their person. All whilst a defense lawyer tries to trick you out of making your statement or shovel the blame back onto you. You better be a good liar to stand up to that sort of pressure!

In the real world, the vast majority of rapists still get away with their crimes. I presume this doesn't sit well with the 'violent stranger in a dark alley' rape narratives that most people seem to assume to be the norm, but it is sadly the case. You pass rapists every day in the street. You work with rapists. You eat with rapists. You share jokes with rapists.

It is like you got so close to contemplating patriarchal theory but took the guy's post as a slur against women.

To boil down the post Unrepresented made, men have largely devised the rule against which crimes are measured. This is certainly the norm in Western culture. These crimes are overwhelmingly the crimes men commit against other men, and are viewed as serious as a result. Therefore the legal system has a system of weightings for 'dude crimes'. Crimes committed against, or by, women are not as important in Western society. Rape is trivial compared to stabbing. People listen to stabbing victims. You never hear stab victims being told "you should have worn thicker clothes", or "you shouldn't have struggled to disarm that guy with the knife, were you trying to lure him or something?". Or "sometimes 'don't stab me' just presents a challenge to your attacker".

Rape is as heinous as any violent crime. Illegally accusing someone of a violent crime is almost as heinous. Both are crimes, both deserve punishment under the law.

Say, if somebody filed a false rape case, should the person filing the false rape case go to prison instead? IMO, the person filing the false rape case should get the same amount of time the accused rapist would have got if he/she were to be convicted.

If it's found that they lied to police/court then they go to jail...
