I have a bad habit of forgetting to "Like" when I post a response disagreeing with something. I tried to go back and like the posts that prompted my responses because I appreciate your viewpoints[1]. And even when we disagree, I appreciate you all and respect your opinions. Hopefully nothing I said came off otherwise.

[1] I also love the level of articulate interaction here. It's far too rare on the net. Stupid Endless September.

May or may not be the best way to have done it. I have seen veiled public announcements like this used to try to get a party to understand something. Can't recall having seen it done by video; usually the venue would be something that peers would see, but not the general public. I am sure that it was done on advice of counsel including the script and when to put it up/take it down. We can debate the quality of counsel they employ.

WRT rollup, yeah, like many have done- including to a small extent Gibson. Not sure what that has to do with anything, other than Gibson's owners sensing more money now.

A roll-up can create value if it is done well (disciplined and planned). But many do it very poorly. It is a business plan that is not fault-tolerant.

It may be a "bargaining chip" but it's an obnoxious bullying approach. That kind of crap pisses me off, whether it's an individual, a gang, a corporation, a politician, whatever. It's uncivil discourse. Take the high road, people.

It looks like there was an impasse of some kind - someone walked away, had an unreasonable non-negotiable... And it was done to get attention back onto the problem at hand. It clearly sends the message "deal with it or we will bury you in court".

I can think of a few thing that might be going on. Top of that list is that somewhere in a public record or a deposition, someone said something incriminating about using Gibson IP. Gibson is using that to extract a license fee that Dean would rather not pay (because it cuts into the cash available for the next acquisition). Dean probably said something to the effect of "so sue us" and walked away and stopped responding. The video is to let Dean know that if they don't return to the bargaining table, the next meeting will be in court (ok, we will sue).

If someone from Dean did say/publish something incriminating with respect to Gibson IP, the license fee could be a good chunk of ongoing revenue - high single digit percentage of revenue from infringing product lines. Gibson can then present that license to the next on the list as "the reasonable license fee" that makes all the threat of litigation go away.

Likewise. I appreciate the respectful interaction regardless of our level of agreement. I suspect we more agree than disagree

I will relate one amusing story of someone who chose to make a public statement because of getting nowhere through other means.

I was at a cardiology conference. During one of the plenary sessions, one of the most respected cardiologists in the atrial fibrillation research community stopped mid presentation and looking directly at a couple of people in the audience (who happen to be from pharmaceutical companies) and said directly to those.
"For the pharmaceutical industry representatives here, I don't need another anti-arrhythmic, I need a better anti-coagulant"
He was not getting this message through by way of service on advisory panels etc. so he chose to "publicly shame" and simultaneously offer to those that would listen how you could garner favour with him.

I would also suggest that putting up the video for a couple of days then taking it down again may be part of a strategy. The video delivered the message to the intended audience while it was up. I would also speculate that it is a direct result of something ongoing about which we know nothing.

I think the strategy here is to demonstrate a willingness to enter into prolonged court proceedings should license issues not be settled/reach an impasse. I also think that Gibson has pockets deep enough to credibly drag on court proceedings to financially harm a potential infringer. Gibson does have registered trademarks, so the onus is on the alleged infringer to show that the trademarks have been vacated. Gibson, like it or not, is still a very valuable brand. To maintain the value of that brand, they must prosecute infringements.

What is amusing to see is the usual TB over-reaction and Gibson bashing. Some things will never change.

I watched the video as well as read what I'd call a ninja hit job article.

What I saw in the video was a company that's proud of its heritage and a company welcoming the movie and music entertainment industry to proudly display the Gibson logo on legit Gibson products vs blacking them out like most movie producers do to avoid trademark or copywright infringement issues. The new Gibson is proud of it's product and wants it to be front and center where ever possible.

What they are not proud of is other companies copying the shape and look of their products. They've given notice to the market that times have changed and the company has changed and they won't tolerate infringements anymore. That part of the video was a relatively small segment of the message.

The back story on all this is that for quite a while now there have been boat loads of counterfeit LP guitars from Asia being dumped on the market. It's really tough for an average buyer to spot the counterfeit. Who knows how many of them are out there and to what degree they might have damaged the Gibson brand with inferior parts or craftsmanship or basement bottom resale values.

Personally, I think Gibson should take every legal action possible to bankrupt and put out of business any company that is building and marketing counterfeit Gibson guitars. Of course we can all argue about what defines "counterfeit" but at the end of the day I'm sure there's a lot of common ground on that definition and that's what Gibby should be going after.

Maybe others put more stock in that function, but I don't take "liking" posts seriously. I find it rather silly, actually. So much so that using 1Blocker for the Safari browser, I hide the Likes bar completely.
