What does that matter as long as the misrepresentation was discovered with in a reasonable time. GC gives 45 days, Sweetwater stands behind there sales for two years with a 45 day no questions asked exchange. I was a week within those standards, regardless if I sold it to anyone else and they discovered the problem.
As a private seller, I don't hold myself to GC standards. While I would give a refund if an obvious issue was found in a reasonable period of time, 5 weeks isn't reasonable. When you add to that a change in ownership, then the seller has no way to know when the more serious issue occurred.
Take the bass to a competent luthier. He may be able to fix the neck. The holes are solved by ordering a new pick guard.
